NOTICE OF VIOLATION (NRC INSPECTION REPORT NOS.
50-259/90-15, 50-260/90-15, AND 50-296/90-15, AND NRC INVESTIGATION REPORT NO.
Q2-89-009)
This refers to the investigation conducted during the period June 19, 1989 through March 1, 1990 of activities at the Browns Ferry Nuclear Plant.
The investigation report synopsis, including pertinent site inspection activities, is enclosed for your information.
The NRC Office of Investigation inquiry reviewed the circumstances associated with the apparent falsification of the quality records for the Restart Test Program, including the TVA identification, investigation, and corrective actions concerning this matter.
Your investigation concluded that there was a high probability that a portion of test 2-BFN-RTP-082 for the diesel generators was not conducted, contrary to the test records.
Other unauthorized test record changes of less significance, by the same individual, were identified.
Our~
inquiry reviewed your documents and interviewed two of your key personnel involved, and concluded that no further NRC inquiry was needed.
Our review concludes that certain activities appeared to violate NRC requirements.
The violation and references to the pertinent requirements are described in the enclosed Notice of Violation.
The violation involves failure to develop and maintain complete and accurate test records and was found to be willful on the part of the responsible individual.
The NRC places great emphasis on the integrity and credibility of individuals performing safety-related activities and the accuracy of the records of such activities.
We are especially concerned about willful violations, and NRC enforcement policy requires that we consider a escalated enforcement in this case.
After our evaluation, escalated enforcement is not warranted since:
TVA identified the matter, it was promptly reported to the NRC, TVA took prompt 'and thorough corrective and disciplinary action, the matter appeared to be limited to one individual, and there appears to be adequate confidence that the restart test program was conducted properly.

We have reviewed your corrective action and no further response to this violation will be required.
Nevertheless, we expect that you will reinforce to Tennessee Valley Authority and contractor employees the importance of integrity in the conduct of all activities that are associated with the safety of the plant.
Recurrence of this type of violation would be considered to represent a potentially significant lack of attention toward licensed responsibilities.
In accordance with Section 2.790(a),
a copy of this letter and its enclosures will be placed in the NRC Public Document Room.
