Dear Commissioners and Staff:

On April 20, 2004, Pacific Gas and Electric Company (PG&E) requested in PG&E Letter DCL-04-036/HBL-04-006, NRC approval of its previously approved Quality Assurance (QA) Program for Radioactive Material Packages Number 0202.

The NRC approved the QA Program in a letter to PG&E dated May 20, 2004 (Approval Number 0202, Revision Number 7). The current QA Program expired on June 30, 2009.

Pursuant to 10 CFR 71.38, PG&E is requesting a renewal of the previously approved QA Program for Radioactive Material Packages Number 0202.

Pursuant to 10 CFR 71.101(f), PG&E intends to continue to apply its 10 CFR 50, Appendix B programs to radioactive material packages used at the Diablo Canyon Power Plant (DCPP) and Humboldt Bay Power Plant (HBPP).

DCPP's QA Program was first submitted to the NRC as part of the original DCPP Final Safety Analysis Report (FSAR) in 1973, and was approved in NRC Supplemental Safety Evaluation Report No. 9, issued in June 1980. The latest docketed version of the DCPP QA Program is contained in Revision 18 of the FSAR Update, submitted to the NRC in PG&E Letter DCL-08-078, dated October 6, 2008.

Document Control Desk PG&E Letter DCL-09-064 September 4, 2009 HBL-09-01 0 Page 2 HBPP's QA Program was first submitted to the NRC as part of the SAFSTOR application on July 30, 1984, and was approved in NRC Safety Evaluation Report, dated April 29, 1987. The latest docketed version of the HBPP QA Program description, contained in Revision 7 of the Unit 3 Defueled Safety Analysis Report, and the most recent revision of the SAFSTOR QA Plan, Revision 21, were both submitted to the NRC in PG&E Letter HBL-08-003, dated March 7, 2008.

There are no new regulatory commitments in this letter.
