Dear Commissioners and Staff:

Pursuant to 10 CFR 26.717, Pacific Gas and Electric Company (PG&E) is submitting the enclosed Fitness for Duty (FFD) Performance Report for the period July through December 2008. The performance data have been compiled on the standard forms developed by the Nuclear Energy Institute, and are provided in . As noted in Enclosure 1, individuals being screened for initial unescorted access (pre-employment testing 30 days prior to being cleared) are tested at lower cutoff levels for marijuana and amphetamines, and for 2 additional substances. This testing is reported under the pre-access category, and is conducted in accordance with 10 CFR 26.

Statistical analysis of the data was conducted and the results are provided in . During this period, no licensed operators or supervisors tested positive. Enclosure 3 provides a summary of program activities for the reporting period.

Enclosure 2 PG&E Letter DCL-09-008 STATISTICAL ANALYSIS FOR REPORTING PERIOD JANUARY THROUGH DECEMBER 2008 Analysis of the data indicates that 52.9 percent of the average eligible population was randomly tested during the period January 1, 2008, through December 31, 2008.

The overall positive test rate for this period was 0.59 percent. Pre-access tests for short-term contractor personnel accounted for 45.5 percent of all positive tests. The large number of positive tests recorded for short-term contractor personnel in the pre-access testing category is attributable to the 1R1 5 Refueling Outage.

There were no random positive test results during this reporting period. The random positive rate for 2008 is 0.07 percent.

Pacific Gas and Electric Company submitted blind performance specimens in accordance with 10 CFR 26.168 requirements. There was one reportable event, see for additional information.

Enclosure 3 PG&E Letter DCL-09-008 FITNESS FOR DUTY PROGRAM ACTIVITY REPORT Activity 1: Unsatisfactory performance test result On August 11, 2008, a blind performance specimen processed at a drug testing laboratory was reported with a negative result. The performance specimen had been spiked with phencyclidine (PCP), and a positive result should have been reported. The laboratory review found-that a posting error to the laboratory computer system caused the incorrect report. The laboratory reported that, "this issue has been reviewed with the certifying scientist involved and training will be conducted with all certifying scientists regarding accurate entry of GC/MS results." A separate report about this was submitted to the NRC on September 19, 2008, (reference PG&E Letter DCL-08-083).
