| Description | Title 10 CFR 50.54(q) requires, in part, that licensees follow and maintain the effectiveness of an emergency plan that meets the requirements in the planning standards of 50.47(b). Title 10 CFR 50.47(b)(4) requires a standard emergency classification and action level scheme is in use by the nuclear facility licensee. Contrary to the above, the licensee failed to use the emergency classification and action level scheme to classify an event. Specifically, the licensee incorrectly used the emergency classification and action level scheme on May 12, 2013, by declaring a Notice of Unusual Event (NOUE) when an electrical transformer was thought to be on fire. The licensee, during a subsequent investigation, determined that the event was not a fire. This finding was more than minor because over classification potentially puts the public at risk and affected the Emergency Preparedness Cornerstone attribute of emergency response organization performance. The finding was evaluated by the Emergency Preparedness Significance Determination Process and determined to be of very low safety significance (Green) because it was a failure to comply with the NRC requirements and was not a loss of planning standard function. The planning standard function was not lost because the emergency classification and action level scheme basis has not changed. This finding was entered into the licensees corrective action program as Condition Report CR-GGN-2013-4156. |
