MASSACHUSETTS INSTITUTE OF TECHNOLOGY - NRC SECURITY-RELATED INSPECTION REPORT NO. 50-020/2015-201

Dear Dr. Newton:

From January 26-29, 2015, the U.S. Nuclear Regulatory Commission (NRC) conducted a security inspection at your research reactor facility. The inspection included a review of activities authorized for your facility. The enclosed report presents the results of that inspection.

The inspection examined activities conducted under your license as they relate to security and compliance with the Commissions rules and regulations, implementation of certain compensatory measures, and compliance with the conditions of your license. The inspector reviewed selected procedures and records, observed activities, and interviewed personnel.

Based on the results of this inspection, the NRC has determined that a Severity Level IV violation of NRC requirements occurred. The violation was evaluated in accordance with the NRC Enforcement Policy included on the NRCs Web site at www.nrc.gov; select What We Do, Enforcement, then Enforcement Policy. The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding it are described in detail in the subject inspection report. The violation is being cited in the Notice because it constitutes a failure to meet regulatory requirements that has more than minor safety significance and the violation is considered repetitive.

The NRC has concluded that information regarding the reason for the violation, the corrective actions planned and taken to correct the violation and prevent recurrence were adequately addressed during the inspection and documented in this inspection report. Therefore, you are not required to respond to this letter unless the description herein does not accurately reflect your corrective actions or your position. In that case, or if you choose to provide additional information, you should follow the instructions specified in the enclosed Notice.

If you contest the violation, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN:

When separated from enclosures, this document is decontrolled. The cover letter of your response, if provided, should be written so that it can be made publicly available.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) Section 2.390 Public inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room from the NRCs document system (Agencywide Documents Access and Management System (ADAMS)).

ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, because of the security-related items contained in the enclosure, and in accordance with 10 CFR 2.390(d), a copy of this letters enclosures will not be available for public inspection.
