Dear Mr. Treadway,

By letter dated August 17, 2023 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML23229A456), Duke Energy Progress, LLC (Duke Energy, the licensee), submitted a license amendment request (LAR) for Brunswick Steam Electric Plant, Unit Nos. 1 and 2 (Brunswick). The proposed amendments would revise the license condition associated with the adoption of 10 CFR 50.69, Risk-informed categorization and treatment of structures, systems and components for nuclear power reactors, that was added to the Brunswick Renewed Facility Operating Licenses upon the issuance of Amendments 292 (Unit 1) and 320 (Unit 2) and revised by Amendments 305 (Unit 1) and 333 (Unit 2).

Specifically, the proposed change would revise the respective license condition to reflect an alternative approach for evaluating the impact of the seismic hazard in the 10 CFR 50.69 categorization process.

The purpose of this email is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this LAR. The acceptance review was performed to determine whether the scope and depth of the technical information was sufficient to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify within the submittal any readily apparent information insufficiencies in the characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an application for an amendment to the license must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications.

The NRC staff has reviewed Duke Energys submittal and concluded that it did provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.

Based on the information provided in Duke Energys submittal, the NRC staff has estimated that this licensing request will take approximately 140 hours0.00162 days <br />0.0389 hours <br />2.314815e-4 weeks <br />5.327e-5 months <br /> to complete and that the review can be completed within 12 months of acceptance of the LAR (i.e., by September 5, 2024). If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during routine interactions between Duke Energy and the NRC project manager. These estimates are based on the NRC staffs initial review of the LAR submittal, and they

could change due to several factors, including requests for additional information and unanticipated addition of scope to the review.
