APPLICATION FOR ISSUANCE OF SUBPCENA Pursuant to Section 2.720 of the Commission's regulations,

" Intervenor Three Mile Island Alert applies to the Administrative Law Judge for the issuance of a Subpoena to Gary L. Milhollin, for -

the purpose of requiring the above named individual to appear to testify as to his knowledge of certain issues.

Mr. Milhollin presided over the reopened phase of the TMI-l restart proceeding. He was in a position to observe the attitude and demeanor of Charles Husted. At the conclusion of the reopened proceeding, Mr. Milhollin produced a report (Report of the Special Master) in which he made certain findings as to Mr. Husted's attitude and demeanor during his December 10, 1981 appearance before the Special Master. In addition, the report contained Mr. Milhollin's findings and conclusions regarding the forthrightness of Husted's testimony. These issues are relevant to the current proceeding.

o WHEREFORE Intervenor TMIA respectfully requests that the Administrative Law Judge issue a Subpoena in the form attached hereto, directing Mr. Milhollin to appear at the hearing granted Charles Husted, scheduled to commence June 23, 1986.

YOU ARE HEREBY COMMANDED to appear to testify in the Hearing requested by Charles Husted as to matters within your knowledge on June 23, 1986, at Harrisburg, Pennsylvania.

You have been subpoenaed by Intervenor Three Mile Island Alert, Inc.

Pursuant to the Commission's regulations at 10 CFR 2.720 (f),

on motion made by you promptly, and in any event before 9:00 a.m.,

on June 23, 1986, and on notice to representative for Intervenor, the Chairman of the Atomic Safety and Licensing Board, or, if he is unavailable, the commission may (1) quash or modify the Subpoena if it is unreasonable or requires evidence not relevant to any matter at issue, or (2) condition denial of the motion on just and reasonable grounds.
