i MS. VIETTI-COOK: The Commission is being asked to act on a l i

memorandum and order in response to a petition to intervene filed by Local 29 International Brotherhood of Electrical Workers with regards to a proposed transfer of 4

l interests in the Beaver Valley Power Station from Duquesne Light Company to First l Energy Corporation. The Commission has voted to approve a memorandum and order which denies the petition to intervene. The Local 29's petition will be treated as a set of comments on the license transfer application pursuant to 10 CFR Section 2.1305.

Would you please affirm your votes?

CHAIRMAN DICUS: Aye.

l COMMISSIONER MCGAFFIGAN: Aye.

COMMISSIONER MERRIFIELD: Aye.

i MS. ANNETTE VIETTI-COOK: Commissioner Diaz had previously indicated that he would approve this paper, and had he been present, he would have affirmed his prior vote. The second item is the Commission is being asked to act on a Memorandum and Order to petitions for review of four partial initial decisions related to i

the materials license issued by Hydro Resources, Inc. The Commission has voted to approve a memorandum and order which partially affirms the decisions in LBP-99-001, LBP-99409, and LBP-99-010. The Commission will address the bifurcation issue in a later decision. The memorandum and order requests the parties submit briefs on LBP-99-013. After reviewing the briefs, the Commission will consider whether to hold oral argument. Would you please affirm your votes?

COMMISSIONER MERRIFIELD: Aye.
