PROPOSED FINDINGS OF FACT AND CONCLUSIONS OF LAW Submitted to : Atomic Safety and Licensing Board From : Dr. Howard M. Deutsch For : Intervenors, Georgians Against Nuclear Energy (GANE) e My name is Howard M. Deutsch, and I testified before the ASLB on Tuessday, March 11, 1986 concering contention 10.5, ASCO solenoid valves.

My testimony clearly pointed out that the testing program ot qualify these valves, conducted by ASCO, Westinghouse, and Franklin Research Center, showed a pattern of early failure. These f a ilure s point out that the valves in que s t ion are not fully qualified and may not be able to perform their safety related function.

I also testified that based on my review, the applicants do not have an adequate maintenance and survie11ance program. For example, after valves are replaced or refurbished, there is no verificaton that they function properly. This question was asked to the panel in cross-examination (transcript of proceedings , 3-13-86, p.528 at 2-7) but no adequate answer given.

In summary the ASLB should rule against the applicants (GPC) and not allow the Votgle Plant of be licensed until it has been clearly demonstrated that qualified solenoid valves will be used for all safety related functions, and that an adequate program for maintenance and survie11ance can be instituted.
