JOINT STIPULATION REGARDING STATUS OF CERTAIN SALISBURY CONTENTIONS The Town of Salisbury ("TOS") and the Applicants hereby submit the following Joint Stipulation, which is intended to resolve the issues raised in certain of Interveners' contentions concerning Salisbury.

A. JI Contention 6 Applicants have agreed that, in the unlikely event of a radiological emergency at Seabrook Station, the ORO would coordinate response with the U.S. Coast Guard, pursuant to the Coast Guard's Radiological Incident Response Plan, to i

ensure that the notification given to boaters by the coast Guard is consistent with navigation conditions then in existence on the Merrim,a'ck River, i.e., the passability of 8903100284 890222 PDR ADOCK 05000443 $D3' G PDR

l the bar at the mouth of the river. Applicants have also clarified that all marinas, where boaters would be instructed to come ashore, are on or within a short walk of Applicants' bus routes.

In light of these agreements and clarifications, TOS agrees that the issue raised in JI Contention 6 has been resolved. TOS accordingly withdraws JI Contention 6.

l B. JI Contention 7 Applicants have agreed to create a contingency travel plan for Salisbury Bus Route 3, to be used if flooding has l

rendered the portion of Ferry Road north of March Road impassable. Under those circumstances, the buses on Route 3 o l

would turn around at Sweet Apple Tree Road. The buses would then run the remainder of Route 3 by proceeding down Bridge Road and March Road and then back.

Applicants have also clarified that they have run buses, without incident, along the unpaved portion of Baker Road, s

thus ensuring its passability.

In light of these revisions and clarifications, TOS agrees that the issues involving Salisbury in JI Contention 7 have been resolved. TOS accordingly withdraws JI Contention 7 to the extent that that contention concerns Salisbury.
