JOINT STIPULATION CONCERNING JI CONTENTION 60 The Town of Newbury, for'itself and on behalf.of:the City of Newburyport and the Town of West Newbury,

-[ hereinafter collectively " Interveners"),and the Applicants hereby submit the following Joint ~ Stipulation, which is intended to resolve the issues raised in JI contention 60.

The Stimulation Applicants have agreed that, to the extent that litigation of JI Contention 4 results in a finding that more Traffic Control Points and/or Access Control Points are needed, and/or that more traffic control devices are needed at existing Traffic Control Points and Access Control Points, j

Applicants will add more traffic cones as required.

Applicants _have further agreed to reflectorize'all traffic cones, for night' visibility.

In light of these commitments and changes by Applicants, Interveners agree that the issues alleged in JI Contention 60 have been resolved. Interveners accordingly withdraw JI contention 60. Interveners continue to press the issues concerning the adequacy of traffic cones and the timing of traffic control establishment raised by them in JI contention 4.
