JOINT STIPULATION REGARDING CITY OF NEWBURYPORT EMERGENCY PLANNING Counsel for the City of Newburyport and the Applicants hereby submit the following Joint Stipulation, which is intended to obviate the need for testimony from the City of Newburyport City Clerk.

1. There is no copy of the Seabrook Plan for Massachusetts Communities ("SPMC") on file with the City of Newburyport city Clerk. The present City Clerk, Michael J. Sullivan, has served since March 30, 1987, and, to the best of his knowledge, no copy i

of the SPMC has been on file with his office since at least that date. This stipulation should not be construed in any manner to indicate whether a copy or copies of the SPMC were offered to the City Clerk's office to be filed.

2. The document entitled " City of Newburyport - Emergency Planning Manual - SARA Title III", a copy of which has been admitted as Applicants' Exhibit 48 in this proceeding, has never i
