ORDER In an opinion issued November 30, 1988, the United States Court of Appeals for the Ninth Circuit granted, in part, a petition for review filed by intervenor Sierra Club. Sierra Club

v. NRC, 862 F.2d 222 (9th Cir. 1988). In gr6nting the petiticn, the Court ordered the agency to hold a hearing en the intervenor's contention regarding the risk of a loss-of-coolant accident resulting in a zircaloy fire, and to develop a record appropriate for review. The Court further ordered that the Licensing Board consider arguments concerning the adequacy of NRC's supplemental environmental assessment. Id. at 231.

The Sierra Club's request for injunctive relief during the pendency of further proceedings in this case was denied by the Court on the ground that it was not supported by a showing of imminent and irreparable harm sufficient to warrant such relief.
