i MEMORANDUM AND-ORDER I
I (Directing Licensee's Response' to Intervenors' Motion for Sumary Disposition)
In a Memorandum and Order dated December 19, 1986 (unpublished),
the Atomic Safety and Licensing Appeal Board referred to this Board Intervenors' December 15, 1986 Motion for Sumary Disposition. That motion was submitted initially to the Appeal Board because Intervenors interpreted our order of December 1,1986 as barring its filing directly with us.
t-Although we stated our view that the filing of motions for sumary disposition was "not warranted", and we accordingly provided no schedule for the filing and disposition of such motions, we did not prohibit them entirely.
It is our intention to rule on Intervenors' motion prior to

a i o' i the scheduled start of hearings in this matter on February 2,1987, if at all possible. To that end, licensee and Staff are directed to file their responses to Intervenors' Motion for Sumary Disposition to be received by the Board on or before January 15, 1987.
