,3EREED JUL 19 :993 ORDER In its July 19, 1993 Memorandum and Order, LBP-93-13, the Atomic Safety and Licensing Board granted a discovery request by the intervenor San Luis Obispo Mothers for Peace for the licensee (

Pacific Gas and Electric Coc.pany to make available under a protective order a report prepared by the Institute for Nuclear Power Operations concerning the Diablo Canyon plant. The Licensing Board has referred its ruling, as the licensee had requested, to the Commission pursuant to 10 C.F.R. 5 2.730(f).

To aid the Commission in its determination as to whether review of the referred ruling is appropriate in accordance with 10 C.F.R. 5 2.786(g) and, assuming that review is appropriate, whether the Licensing Board's order should be sustained, the parties are invited to file briefs with the Commission in accordance with the follcwing schedule:

1. The licensee may file a brief with the Secretary of the Commission no later than the close of business (4:15 pm Eastern Standard Time) on July 23, 1993; the licensee shall ensure that service is complete on the other parties at essentially the same time; p DD

2. The intervenor and the NRC staff may file a reply brief with the Secretary of the Commission no later than the close of business (4:15 pm Eastern Standard Time) on July 29, 1993; service on the other parties shall be accomplished by express mail or its equivalent.

No further right of reply is granted.
