OL Wells Eddleman's Requests for Subpoenas on Contention 57-C-3 (Night-time Notification)

Pursuant to the Board's Order of 1-24-86 and 10 CFR 2.720(a),

and other applicable rules, Wells Eddleman hereby moves that the Board Chairperson issue subpoenas for the following persons:

Jesse Riley, 854 Henley Place, Charlotte NC 28207 (7.0h-375-h3h2);

Dr. M. Reada Bassiouni, ATI, 22 Union Wharf, Boston MA OP109, (617-367-016h); Bob Black, CP&L, Box 1551 Raleigh NC P7602, as my witnesses, and for Eugene J. McKinney of Southern Bell Marketing, 800-532-6786 (w),

70h-365-0571 (h) as a Board witness on telenhone alerting systems.

Mr. McKinney is knowledgeable about available telephone dialing systems as well as those under development. I understand his managemen t is not in favor of his testifying voluntarily for n'nyono, but being subpoenaed as a Board witness is the best alternative.

Note that, first, his testimony is relevant since the contention calls for the use of telephona alerting systems and no testimony has been presented on that issue. Also, per the VC Summer test, the Board in its order of 1-16-86 found the record deficient (item 6) concerning mechanisms such as the telephone alerting system caTled for by the E WJ 1.SC> S

l contention. The Board allowed the PEMA staff, NRC Staff and Anplicants

, o proyide testimony or the telephone alerting system (it's mentioned in FEMA-43), but none have indicat'ed they will. Thus, the e !s no  ;

alternative (since Intervenor cannot get voluntary testimony) to the Board's calling Mr. McKinney as its witness on telenhone alerting systens

, Dr. Bassiouni and Mr. Black were the principal affiants in summary disposition on 57-C-3 Both have extensive knowledge relevant to this contention, and Dr. Bassiouni has wide experience with about 4/5 of the nuclear utilities in the US concerning alerting systems including tone alert radios, telephone, and other systems as well as sirens. Dr.

Bassiouni is well qualified to answer the Board's questions 1,3,h,5 and 6 (or questions arising under those items in the 1-16-86 order), and he has stated he has knowledge concerning item 2 (the Gernaa siren . study which he brought to the attention of the Board and narties). Mr. Black, as CP&L's senior emergency n1anning person, knows the CP&L alerting system, alternatives considered for expanding / augmenting it (item 6) and can assist in calculation of numbers of households. In addition he nay have both opinions and information Applicants have withheld from the equivalent situation to testimony (a reliable source showed this was trde when Dr. Bassiouni j

was not called on Contention 57-C-3 originally). Mr. Black should be familiar with both the alerting system and calculations concerning it, as well as telephone dialing systems, tone alert radios, etc.

Mr. Riley, as an intervenor's representative in the Catawba _ NRC proceeding (50-413/h14 OL) dealt with telephone alertin6 . systems and has knowledge concerning the effectiveness of alerting systems (Item

1) and knowledge of siren alerting systems and telephone alerting as a backup / supplement (Item 6) and has extensive experience in calculation which may be useful in dealing with items 2 thru 5 of

the Board's 1-16-86 Order.

Having shown the relevance of the above-named witnesses' testimony, and the apnropriateness of calling Mr McKinng as a -

Board witness, Wells Eddleman hereby reouests that the subpoena,s, duces tecum (attached to Board, Applicants, Staff and NRC DociNiiing and Service conies only) be executed by the Board Presiding Officer in order that the information and knowledge of these nersons, which is inportant, and in the cases of Dr. Bass!ouni and others vital, to the resolution of the issues in this proceeding including especially the 6 items reopened by the Board 1-16-86, most particularly item 6 and reliable information on items 1-5 It is expected that Dr. Bassiouni's knowledge of tone-alert radio systems tried (and in some cases scranped) by other utilities will be nost particularly relevant in light of Applicants' new plan to provide tone-alert radios within 5 miles of the Harris nuclear plant.
