  • tiOTlOtt TO STRIKE BASIS M The Massachusetts Attorney General ("the Mass AG") and the Applicants file the following Joir' Stipulation regarding Applicants' Motion to Strike Basis of Mass AG's "Amended Contention on Notification System" in the flature of a Renewed Motion for Sanctions Against Mass AG for Failure to Comply with the Daard's Discovery Order (Motion to Strike).
1. The Applicants have provided to the Mass AG information sufficient to establish that they have contracted with a firm to remove snow from each of the acoustic locations after each measurable snowfall. Based on that information, the Mass AG withdraws its allegation that the acoustic locations will be inaccessible during the wintertime because of the lack of snowplowing. The Mass AG continues to press the remaining portions of Basis A.3.
