ENCLOSURE 1 NOTICE OF VIOLATION Babcock and Wilcox Company Docket No.70-824 NNFD Research Laboratory License No. SNM-778 Lynchburg, VA During the Nuclear Regulatory Comission' (NRC) inspection conducted on

.May 23-25, 1988, violations of NRC requirements were identified. The violations involved: (1) Failure to provide the opportunity for local emergency assistance personnel to annually tour the facility; (2) Failure to perform periodic meteorological instrument calibration as required by procedure (RL-IP-1713-01 ; (3) Failure to perform a test of the communicaticas lids and notification procedures for early warning of the put,?ic between f N. ,ite and State and local emergency units during the annual dr,'1; eM (4 : Failure to provide annual retraining for members o_f the Emergency Control hrganization.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the violations are listed below:

A. Condition 9 of Special Nuclear Materials License No. SNM-778 requires that licensed material be used in accordance with statements, representations, and conditions contained in Chapter. I thru 8 of the license application dated November 26, 1985, and supplements dated May 27, and June 19, 1986 and January 20, April 27, May 26, August -10, and September 1,1987.

Chapter 8, "Radiological Contingency Plan," of the application require that the licensee shall maintain a capability for handling emergencies in accordance with the Radiological Contingency Plan. Section 7.2, "Training of the Radiological Contingency Plan," states that members of the Emergency Control Organization will be retrained annually. In addition, training in emergency response begins with the indoctrination of each new employee in his assigned responsibility in time of emergency.

Contrary to the above, the licensee failed to provide indoctrination as well as anr.ual retraining for members of the Emergency Control Organization. Two of three Emergency Officers have received no indoctrination training in their assigned responsibility. The receptionist and alternate, who perform notification at the direction of the Emergency Officer, have not received indoctrination as well as annual retraining for their assigned responsibilities.

This is a Severity Level IV violation (Supplement VIII).

B. Condition 9 of Special Nuclear Materials License No. SNM-778 requires that 1 licensed material be used in accordance with statements, representations  !

Contrary to the above, the licensee has not tested the communication links and notification procedures for early warning of the public between the Site and State and local emergency units during the annual drill.

This is a Severity Level IV violation (Supplement VIII).

C. Condition 9 of Special Nuclear Materials License No. SNM-778 requires that licensed material be used in accordance with statements, representations, and conditions contained in Chapter 1 thru 8 of the license application dated November 26, 1985, and supplements dated May 27, and June 19,,1986 and January 20, A'pril 27, May 26, August 10, and September 1,1987.

Chapter 8, "Radiological Contingency Plan," of the application requires that the licensee shall maintain a capability for handling emergercies in accordance with the Radiological Contingency Plan. Procedtre RL-IP-1713-01, "Measuring Equipment Control and Calibration System,"

defines an administrative system to control the calibration of all measurement stcndards and measuring and test equipment used at the site in ,

order to assure that measurements made are qualifiable and reproducible. l The procedure requires that the meteorological instruments be caliarated '

on a 6 month frequency.

Contrary to the above, the licensee has not pei formed periodic meteorological instrument calibration at a 6 month frequency in that -the temperature recorder was last calibrated in May 1987.

This is a Severity Level IV violation (Supplement Vill).

D. Condition 9 of Special Nuclear Materials License No. SNM-778 requires that licensed material be used in accordance with statements, representations and conditions contained in Chapters 1 thru 8 of the license application d6ted November 26, 1985, and supplements datrd May 27, and June 19, 1986 and January 20, April 27, May 26, August 10, and September 1, 1987.

Chapter 8, "Radiological Contingency Plan," of the application requires that the licensee will maintain a capability for handling emergencies in accordance with the Radiological Contingency Plan.

Section 7.2, "Training of the Radiological Contingency Plan," states that a tour of the facility for local emergency assistance personnel will be conducted annually.

Babcock and Wilcox Company Docket No.70-824 NNFO Research Laboratory 3 License No. SNM-778 Contrary to the above the licensee has not provided' the opportunity for-local emergency assistance personnel to annually tour the facility, in that the 'last tour 'of the f acility for local emergency assistance personnel occurred in December 1986.

This is a Severity Level V violation (Supplement VIII).

Pursuant to the provisions of 10 CFR 2.201, Babcock and Wilcox Company is hereby required to submit 'a written statement or explanation to the Nuclear Regulatcry Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident inspector, Naval Nuclear Feel Division, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked .as a "Reply to a Notice of Violation" and should include [for each violation): (1) admission or denial of the violation, (2) the reason for the violaticn if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be _taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.' If an adequate reply is not received within the time specified.in this Notice, an order may be issued to' show cause why the license should not be modified, '

suspended, or revoked or why such other action as may be proper should not be taken.

Security or safeguards information should be submitted as an enclosure to facilitate withholding it from public disclosure as required by 10.CFR 2.790(d) or 10 CFR 73.21. <
