NOTICE OF VIOLATION (NRC INSPECTION REPORT N0. 70-824/88-04)

This refers to the Nuclear Regulatory Commission (NRC) hspection conducted j E. D. Testa on May 23-25, 1988. The inspection includra a review of activities authorized for your Naval Nuclear Fuel Division Reseirch Lab;ratory.

At the conclusion of the insp.ection the findings were discussed with tnose members of your staff identified in the enclosed inspection report.

In SJdition, on June 1,1983, D. M. Collins of this office discussed with L. K. Trent of Babcock and Wilcox the need for increased management attention in the area of emergency preparedness. During this conversation, Mr. Trent stated that he and his management were providing an increased level of attention to the program and would assure adequate resources where applied to improve the program.

Areas examined during the inspection are identified in the report.

Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observations of activities in progress.

The inspect;on indicated that certain activities appear to violate NRC requirements.

The violations, references to pertinent requirements, and elements to be included in your response are described in the enclosed Notice of Violation.

In accordance with Section 2.790 of the NRC's Rules and Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and its anclosure will be placed in the NRC Public Document Room.

The response directed by this letter and its enclosure are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980 PL 96-511.
