ENCLOSURE 1 NOTICE OF VIOLATION Babcock and Wilcox Company Docket No.70-824 4
NNFD-Research Laboratory License No. SNM-778 4
During the Nuclear Regulatory Commission (NRC) inspection conducted on March 13-14 and 28-30,1989, violations of NPC requirements were identified.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989), the violations are listed below:
A.
Condition 9 of Special Nuclear Materials License No. SNM-778 requires that licensed material be used in accordance with statements, representations, and conditions contained in Chapters 1 thru 8 of the license application dated November 26, 1985, and supplements thereto.
Chapter 2, " General Organizational and Administrative Requirements," Section 2.2.8, states the Industrial Safety Officer shall administer the Industrial Safety Program.
According to Section 10.5.3 of License No. SNM-778, Industrial Safety is responsible for reutine inspection and maintenance of portable fire extinguishers. Administrative Procedure No. 19.3 of the Industrial Safety Manual states that an inspection of LRC portable fire extinguishers will be conducted each month.
Contrary to the above, the licensee failed to perform inspections during December 1988 and January 1989.
This is a Severity Level IV violation (Supplement VIII).
B.
Condition 9 of Special Nuclear Materials License No. SNM-778 requires that licensed material be used in accordance with statements, representations, and conditions contained in Chapters 1 thru 8 of the license application, dated November 26, 1985, and supplements thereto.
Chapter 8
" Radiological Contingency Plan," of the application requires that the licensee shall maintain a capability for handling emergencies in accordance with the Radiological Contingency Plan.
Section 7.2, " Training," states that the fire and rescue team portion of the Emergency Control Organization undergoes quarterly training which includes hands-on and/or classroom training.
Contrary to the above, the licensee had not conducted fire and rescue team training during the period of October 1988 thru March 1989.
This is a Severity Level IV violation (Supplement VIII).

License No. SNM-778 Pursuant to the provisions of 10 CFR 2.201, Babcock and Wilcox Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory-Commission, ATTN:
Document Control. Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, within 30 days of the date of the letter transmitting this Notice.
This reply should be clearly marked as a " Reply to a Notice of Violation" and should include [for each violation]:
(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective ' steps which have been taken and the.
results achieved,-(4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good' cause is shown, consideration will be given to extending the response time.
If~
an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended. or revoked or why such other action as may be proper should'not be taken.
