ENCLOSURE 1 j NOTICE OF VIOLATION l

} Babcock and Wilcox Company Docket No.70-824 Lynchburg Research Center License No. SNM-778 The following violations were identified during an inspection conducted on 1.

October 7-11, 1985. The Severity Levels were assigned in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C).

I 1. 10 CFR 20, Appendix A, footnote h, required that airline pressure gauges or flow measuring devices be calibrated if a protection factor is used for supplied-air hoods.

Contrary to the above, during the period September 1,1983 to August 16, 1985, the licensee used airline pressure gauges which were not calibrated j and protection factor credit of 1,000 was taken for the supplied-air hoods.

i This is a Severity Level IV violation (Supplement IV).

2. 10 CFR 20.203(c)(2) required that a licensee, who establishes a high
radiation area for 30 days or more, control each entrance or access to the

, area by equipping it with a control device which shall cause the level of  ;

i radiation to be reduced below that at which an individual might receive a i dose of 100 millirems in one hour upon entry into the area, or which shall energize a conspicuous visible or audible alarm signal in such a manner that i

l the individual entering the high radiation area and the licensee or a supervisor of the activity are made aware of the entry; or by maintaining it '

i locked except during periods when access to the area is required, with

positive control over each individual entry, i Contrary to the above, on October 8, 1985, the licensee failed to control by i any of the specified methods a ladder placed against the Building B hot cell outer wall in the cask bandling area which provided access to a permanent l high radiation area on the hot cell roof. Radiation levels on the hot cell

} roof were up to 3,500 millirem per hour.

This is a Severity Level IV violation (Supplement IV).
3. 10 CFR 20.201(b) required that each licensee shall make or cause to be made

! such surveys as may be necessary for the licensee to comply with the  :

regulations and are reasonable under the circumstances to evaluate the extent of radiation hazards that may be present.

, Contrary to the above, during June and July,1985 the licensee did not make 3 such surveys as were necessary to evaluate the extent of beta radiation hazards and to ensure that the beta radiation exposure of personnel entering i

Babcock and dilcox Company 2 Docket No.70-824 Lynchburg Research Center License No. SNM-778 the Building B hot cells were within the limits specified in 10 CFR 20.101(a) in that no beta radiation surveys were performed either prior to or during personnel hot cell entries.

This is a Severity Level IV violation (Supplement IV).

Pursuaat to 10 CFR 2.201, you are required to submit to this office within 30 days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged violations; (2) the reasons for the violations if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved.

Security or safeguards information should be submitted as an enclosure to facilitate withholding it from public disclosure as required by 10 CFR 2.790(d) or 10 CFR 73.21.
