ASSESSMENT FOLLOW-UP LETTER - ST. LUCIE NUCLEAR PLANT UNIT 1

Dear Mr. Nazar:

On April 19, 2010, the NRC issued the final significance determination of an inspection finding and a Notice of Violation related to air intrusion into the Component Cooling Water (CCW) system (ML101090509). The NRC has concluded that this violation involving the failure to identify and correct the source of the air in-leakage into the CCW system was characterized as Yellow, i.e., a finding of substantial significance with regard to safety, requiring additional NRC inspections. This Yellow finding was in the Initiating Events cornerstone.

As a result of our review, we have assessed St. Lucie Unit 1 performance to be in the Degraded Cornerstone column of the NRC=s Action Matrix as of the 4th quarter of calendar year (CY) 2009.

On April 28, 2010, we were notified by your staff of the status of your readiness for the NRC to conduct a supplemental inspection to review the actions taken to address the failure to identify and correct the source of the air in-leakage into the CCW system. Accordingly, we plan to conduct a supplemental inspection in accordance with Inspection Procedure 95002 in September 2010.

This inspection is conducted to provide assurance that the root and contributing causes for the individual and collective risk significant performance issues are understood, to independently assess the extent of condition, to provide assurance that the corrective actions are sufficient to prevent recurrence, and to independently determine if safety culture components caused or significantly contributed to the individual risk significant performance issues.

In accordance with 10 CFR 2.390 of the NRC=s ARules of Practice,@ a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
