SUBJECT: DENIAL OF NON-CITED VIOLATION, NRC REPORT 05000313/2015002 AND 05000368/2015002

Dear Mr. Browning:

This letter acknowledges your September 3, 2015, correspondence in response to our letter, dated August 5, 2015. On August 5, 2015, the U.S. Nuclear Regulatory Commission (NRC) documented Arkansas Nuclear One's failure to establish and maintain an adequate testing program for the fuel oil transfer piping for Units 1 and 2. This violation was documented as Non-cited Violation (NCV)05000313/2015002-04; 05000368/2015002-04, "Failure to Perform Testing of Diesel Fuel Oil Transfer Piping." The non-cited violation enclosed in NRC Inspection Report 05000313/2015002 and 05000368/2015002 (ML15218A371) required you to respond in writing within 30 days. On September 3, 2015, the NRC received a letter from you contesting this violation. The NRC is currently reviewing your basis for contesting the violation in accordance with Part I, Chapter 2, Section 2.2.8, of the Enforcement Manual. Accordingly, we will provide the results of our evaluation by written response within 90 days of the receipt of your letter. In accordance with 10 CFR 2.390, "Public Inspections, Exemptions, Requests for Withholding," of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC's Public Document Room or from the Publicly Available Records (PARS) component of the NRC's Agencywide Documents Access and Management System (ADAMS) ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html the Public Electronic Reading Room).
