Ladies and Gentlemen:

The U.S. Nuclear Regulatory Commission (NRC) issued the Vogtle Electric Generating Plant (VEGP) Units 3 and 4 combined licenses (COL) (License Nos. NPF-91 and NPF-92) to Southern Nuclear Operating Company (SNC) on February 10, 2012.

By SNC letter ND-18-1408, dated November 16, 2018, SNC submitted License Amendment Request (LAR), LAR-18-028 (ADAMS Accession Number ML18320A225), to revise information in the VEGP Units 3 and 4 licensing basis documents. The LAR proposes to change the routing of Class 1E divisional cables supporting passive containment cooling.

SNC is submitting this Preliminary Amendment Request (PAR), PAR-18-028, to minimize construction delays for VEGP Units 3 and 4 during the NRCs evaluation of the related LAR. The determination of whether the NRC has any objection to SNC proceeding with construction based on the proposed licensing basis changes identified in the LAR is requested on or before January 7, 2019. Delayed determination regarding this PAR could result in delay of the completion of installation of divisional cable raceway and the associated cables in rooms affected by the LAR.

A description of the proposed change and the reason for the change are contained in the Enclosure to this letter. This PAR has been developed in accordance with guidance provided in the most recent revision to the Interim Staff Guidance on Changes during Construction Under 10 CFR Part 52, COL-ISG-25 [ADAMS Accession Number ML15058A377] and corresponds accurately and technically with the above-mentioned LAR-18-028. The technical scope of this PAR is consistent with the subject LAR. Section 7 of the Enclosure further identifies and details the scope of the no objection finding sought in this PAR.

ND-18-1476 Enclosure PAR-18-028: Routing of Class 1E Divisional Cables Supporting Passive Containment Cooling Pursuant to 10 CFR 52.98(c) and in accordance with 10 CFR 50.90, Southern Nuclear Operating Company (SNC) submitted license amendment request (LAR)-18-028 to change the Vogtle Electric Generating Plant (VEGP) Units 3 and 4 licensing basis documents associated with Combined License Nos. NPF-91 and NPF-92, respectively.

Accordingly, SNC requests the determination of whether the NRC has any objection to SNC proceeding with construction of VEGP Units 3 and 4 routing of Class 1E divisional cables supporting passive containment cooling, which is subject to the changes proposed in LAR-18-028.

Delayed determination regarding this PAR will result in delay in the construction completion of VEGP Units 3 and 4, as identified in the Preliminary Amendment Request (PAR) provided below, to be provided by the date shown below.

3. Brief Description of Proposed Change:

The proposed change would revise licensing basis information in the Updated Final Safety Analysis Report (UFSAR) Tier 2 information (plant-specific DCD), which involves a change to the COL Appendix C and corresponding plant-specific Tier 1 information in Table 3.3-3 to reflect revised routing of divisional cables supporting passive containment cooling system (PCS) functions. Additionally, related consistency revisions in the safe shutdown evaluation divisional separation information are proposed.

These changes impact COL Appendix C (and corresponding plant-specific Tier 1) Table 3.3-3, and UFSAR Table 3.7.3-1, Subsection 9.5.1, and Appendix 9A (various subsections),

including Table 9A-2, Table 9A-3 and Table 9A-4.

4. Reason for License Amendment Request:

When the shield building changed from reinforced concrete to modular construction in the enhanced shield building design, the modular design and the associated revised structural elements created an interference with the embedded raceway. As a result, a design change is necessary to reroute the electrical raceways which are intended to support the Class 1E dc and Uninterruptible Power Supply (UPS) System (IDS) Class 1E cabling for the loads located in the PCS valve room, which consists of Division A, Division B, and Division C, as well as non-safety raceways.

To determine the licensing basis impact of this change activity, an extensive review was performed of the routing of the affected Class 1E dc cables supporting PCS components.

This review also identified additional impacts to the licensing basis fire protection analysis as described in UFSAR Appendix 9A. The fire areas in this appendix identify the room(s)

ND-18-1476 Enclosure PAR-18-028: Routing of Class 1E Divisional Cables Supporting Passive Containment Cooling that comprise the fire area and are assessed, in part, to confirm the capability to safely shut down the plant following a fire. Details pertaining to the safe shutdown components for these fire areas are tabulated in UFSAR Table 9A-2 and include IDS Class 1E cables/trays, as applicable.

The proposed change requires a change to Tier 2 information in UFSAR and involves a change to Tier 1 information. Therefore, the proposed change requires NRC approval in accordance with 10 CFR 52.98(c).

Additional details are provided in the referenced LAR-18-028.

5. Is Exemption Request Required? Yes No If Yes, Briefly Describe the Reason for the Exemption.

No exemption required for the PAR. An exemption is required for the LAR since a change is needed to the Tier 1 information incorporated by reference into 10 CFR Part 52, Appendix D.

6. Identify Applicable Precedents:

No precedent identified.

7. Impact of Change on Installation and Testing Schedules:

A delayed determination regarding this PAR will result in delay of the installation of divisional cable raceway (e.g., tray and conduit) and associated cable for the Vogtle Units 3 and 4, as described below.

As such, this PAR requests a no objection finding related to the changes described in LAR-18-028 by the date identified in Block 1 above (or sooner if reasonably achievable) to allow for appropriate notifications and release of further activities dependent on construction of the Vogtle Units 3 and 4 divisional cable raceway and associated cable, as noted below.

Specifically, SNC is requesting a no objection finding to allow:

Installation of Division D cable raceway and associated cable in Fire Area 1201 AF 02 Room Nos. 12104, 12204, 12207, 12304, and 12344 Installation of Division B cable raceway and associated cable in Fire Area 1201 AF 03 Room Nos. 12105, 12205, 12305, and 12345 Installation of Division B, C and D cable raceway and associated cable in Fire Area 1204 AF 01 Room No. 12163 Installation of Division A and C cable raceway and associated cable in Fire Area 1200 AF 03 Room Nos. 12311 and 12411 Installation of Division C cable raceway and associated cable in Fire Area 1242 AF 02 Room No. 12412 Construction holds have been issued for these activities.

A no objection finding for the above activities would allow for VEGP Units 3 and 4 construction activities to proceed.

8. Impact of Change on ITAAC:

ITAAC 337 (2.3.04.10), ITAAC 795 (3.3.00.07c.i.a), ITAAC 796 (3.3.00.07c.i.b), ITAAC 797 (3.3.00.07c.ii.a), and ITAAC 798 (3.3.00.07c.ii.b), are affected by this changes identified in the LAR.

The testing of the as-built individual fire detectors will be performed in the fire areas identified in Table 3.3-3. This PAR does not impact this testing as it is not scheduled until well after the requested approval date for the LAR.

The separation maintained between Class 1E divisions in the fire areas identified in Table 3.3-3 is impacted as the specific divisions in each room are revised. The revised routing will continue to meet the separation standards identified in the UFSAR.

Final approval of the License Amendment Request will be necessary for closure of the related ITAAC, but a no objection finding is requested for this PAR in order to proceed with construction pursuant to the process outlined in COL Condition 2.D(1), Changes during Construction. This PAR should be considered for any inspections related to ITAAC 3.3.00.07c (item Nos. 795, 796, 797 and 798) of the VEGP Units 3 and 4 COL Appendix C Table 3.3-3.
