The U.S. Nuclear Regulatory Commission (NRC) issued Combined License (COL) NPF-92 to Southern Nuclear Operating Company (SNC) pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 52.97, "Issuance of combined licenses," on February 10, 2012.

Two license conditions require SNC to submit, no later than twelve months after issuance of the COL, the following:

A schedule for implementation of the operational programs listed in the Final Safety Analysis Report Table 13.4-201, including the associated estimated date for initial loading of fuel (COL section 2.D.(11))

A schedule for implementation of the license conditions listed in COL section 2.D.(12)(f)1-9 In accordance with the license conditions, the schedules shall be updated every six months until twelve months before scheduled fuel loading, and every month thereafter until each license condition has been fully implemented.

U.S. Nuclear Regulatory Commission ND-23-0669 Page 2 of 3 On July 20, 2023, SNC submitted the Unit 4 notification of completion of all ITAAC in accordance with 10 CFR 52.99(c)(4) and License Condition 2.D.(2)(d), Agencywide Documents Access and Management System (ADAMS) Accession Number ML23201A266. On July 28, 2023, NRC issued the 10 CFR 52.103(g) finding for Unit 4, ADAMS Accession Number ML22348A093. Therefore, a schedule submittal per 10 CFR 52.99(a) is not required.

On November 11, 2021, SNC submitted the scheduled date for initial loading of fuel at VEGP Unit 4, Agencywide Documents Access and Management System (ADAMS) Accession Number ML21315A011.

This submittal stated updates to the scheduled date for initial loading of fuel would be made every 30 days in accordance with 10 CFR 52.103(a). The scheduled date for initial loading of fuel at VEGP Unit 4 is provided in the enclosure.

The enclosure contains the Unit 4 COL Operational Programs and Other License Conditions Implementation Schedule and the scheduled date for initial loading of fuel at VEGP Unit 4. As is typical with a construction project, the schedule information is dynamic in nature.

The schedule information provided in the enclosure is considered confidential commercial information and exempt from mandatory public disclosure pursuant to the provisions of 10 CFR 2.390(a)(4) and 10 CFR 9.17(a)(4). Following the approach described in SECY-06-0114, no additional withholding determination is needed as the schedule information was demonstrated to be confidential commercial information based on the schedule updates provided to the NRC on February 8, 2019, ADAMS Accession Number ML19039A264, and on October 6, 2017, ADAMS Accession Number ML17279A661.

Accordingly, the enclosure to this letter should be withheld from public disclosure.
