Army Corps of Engineers (USACE) Section 404 permit, Permit SAS-2007-01837, at the Vogtle Electric Generation Plant in Waynesboro, Georgia. The authorized permit included 1.40 acres of wetland impacts for a temporary sedimentation pond. In lieu of removing the temporary sediment basin, SNC is proposing to modify the outlet structure of the temporary sedimentation pond to create a permanent storm water detention basin. The pond currently provides stormwater retention and serves as a best management practice (BMP) to improve the water quality of runoff from the adjacent constructed slopes, River Water Intake Structure (RWIS) facility and other site developments. This proposed modification will not increase wetland impacts, but it would change 1.40 acres of temporary impacts associated with the sedimentation pond to permanent impacts. SNC proposes to purchase additional wetland mitigation credits from an approved wetland mitigation bank to compensate for the conversion of temporary to permanent wetland impacts.
Per your suggested course of action in recent conversations with Mr. Jim DeLano at SNC and Mr. Jonathan Bourdeau at Wood Environment and Infrastructure Solutions, Inc. (Wood), we are submitting the following information to support this modification request. Following receipt of this request, we understand that you will assign this modification request to a project manager in the USACE Coastal Branch for review.
1. Background
Alvin W. Vogtle Electric Generation Plant, (VEGP), operated by SNC, is located in central Burke County, near Waynesboro, Georgia, west of the South Carolina border. SNC is currently in the process of constructing VEGP Units 3 and 4. These units are Westinghouse AP 1000 simplified passive advanced light water reactors. The VEGP currently has two operating Westinghouse pressurized water reactors operating at the facility. The new plant footprint for VEGP Units 3 and 4 is adjacent to the west side of VEGP Units 1 and 2.

ND-20-EVC-0428 Regulatory Branch Savannah District U. S. Army Corps of Engineers To start-up and operate Units 3 and 4, additional surface water supply is necessary. SNC submitted a Section 404 Individual Permit Application to USACE for proposed temporary and permanent impacts to wetlands and streams, as well as compensatory mitigation for the impacts. Compensatory mitigation was the purchase of mitigation credits from approved Georgia wetland mitigation banks. The Section 404 permit (Permit SAS-2007-01837) was subsequently authorized in 2010, and compensatory mitigation credits were purchased in 2011.
The original Section 404 Permit was issued on September 30, 2010 for the construction of two new nuclear Units 3 & 4, associated infrastructure, power lines, building construction, water intake structures, access roads, and water discharge pipes at VEGP. The original permit authorized impacts to 9.23 acres of wetlands, 734 linear feet (1.42 acres of open water) along the Savannah River, and 0.07 acres of ephemeral stream. In 2015, prior to the expiration of the 2010 permit, SNC requested a permit extension, and USACE granted a permit extension through 2020.
A total of 6.49 acres of permanent wetland impacts and 2.74 acres of temporary wetland impacts were authorized. To construct the RWIS and the RWIS road, permanent wetland impacts included 5.50 acres of fill and 0.99 acres of dredging. Permitted temporary impacts in this area included 1.40 acres of both dredge and fill and were associated with a sediment basin, installation of silt fence and other stormwater BMPs. The construction activities associated with the authorized permanent impacts are complete. If the proposed permit modification and additional compensatory mitigation are not approved, the temporary impacts that require removal include a temporary sediment basin, grouted riprap and gabion slope protection, a 60x140 concrete pad, a corrugated metal outlet standpipe, and plywood baffles. The wetland impacts are described and graphically shown on Sheet 1, Proposed Conditions, dated January 15, 2010 as part of the USACE Permit SAS-2007-01837 (Attachment 1). The detailed construction plan for this area, Sheet SV0-0000-XD-012, is provided as Attachment 2.
A summary of the wetland impacts for the project are given in Table 1.

- 2. Rationale for Retaining the Temporary Sedimentation Pond and Infrastructure SNCs position is that it is both prudent and consistent with Special Condition 9 of the current permit to convert the sedimentation basin and leave the adjacent portion of the access road in place. The basin is currently providing stormwater retention and serves as a BMP to improve water quality runoff from the adjacent constructed slopes, RWIS facility and other site development features (road and storm water conveyances). The temporary sedimentation basin would be converted to a permanent water quality detention basin by modifying the outlet structure. During plant operations, the pond will serve as a BMP to limit potential inadvertent impacts to wetlands or waters of the U.S. from equipment and site infrastructure. Some examples include:
x Plant equipment (a ~500 gallon mineral oil filled transformer and miscellaneous pumps) x Non-point source pollutants from the adjacent roads and slopes x
Management of storm water runoff from adjacent slopes Some of the other non-point source pollutants may include oils (from normal vehicle operations) and/or debris from the adjacent road. For example, trash and debris that accumulate in the RWIS will be removed via traveling screens and placed into dumpsters. These dumpsters are hauled off along the road between the pond and the wetlands. The roadway drainage system currently discharges into the pond which serves to enhance the water quality prior to discharge into the wetlands. The constructed slope behind the intake structure is over 100 feet in height and drains toward the pond via a concrete channel at the toe of the slope. The pond serves to buffer the wetlands and Savannah River from the storm water run-off.
Photos of the current condition of the sedimentation basin are shown in Attachment 3.
- 3. Wetland Mitigation Information from the 2010 Permit Based on the Mitigation Credit Purchase Evaluation (dated 3/17/2010) from the original permit application, SNC was required to purchase 77.8 freshwater wetland mitigation credits and 2,224 stream mitigation credits (Attachment 4). In accordance with Special Conditions 1 and 2, the required 77.8 wetland mitigation credits and 2,224 stream mitigation credits were purchased in 2011. The wetland credit purchase consisted of 45.53 credits from Phinzy Swamp Wetland Mitigation bank on 4/6/2011 and 32.27 credits from Brushy Creek Mitigation Bank on 4/21/2011 (Attachment 5). The stream credit purchase consisted of 2,224 credits from Bath Branch Stream Mitigation Bank on 2/25/2011 (Attachment 5).
- 4. Proposed Changes to Wetland Impacts and Mitigation The proposed permit modification requires converting 1.40 acres of wetland impact from temporary to permanent.
SNC has completed the construction activities associated with the disturbance of 1.34 acres of temporary impacts associated with Wetland BJ, performed restoration activities, and terminated the NPDES construction storm water permit. The Notice of Termination (NOT) for permit GAR124823-V2 was submitted July 26, 2018.

Army Corps of Engineers The Wetland and Open Waters Mitigation Worksheet (dated 3/15/2010) from the original permit application indicated that a total of 10.42 mitigation credits would be required for the temporary sediment basin (1.98 credits for fill and 8.44 credits for dredging/excavation). Had the sediment basin been intended to be permanent during the initial permitting, the required credits would have been 12.52 (2.37 for fill and 10.15 for dredging/excavation, calculated by changing the duration of effect on the calculation worksheet from 0.5 to 2.0, Attachment 6). The difference between the temporary and permanent impacts based on the former mitigation calculations is 2.10 wetland mitigation credits (see Table 2 below). SNC proposes to purchase the additional 2.10 wetland mitigation credits from an approved mitigation bank in Georgia.

SNC purchased a portion of the originally authorized wetland mitigation credits from Phinzy Swamp Mitigation Bank. If USACE approves this permit modification and mitigation approach, SNC will prepare and submit a Statement of Credit Availability (SOCA) from Phinzy Swamp Mitigation Bank to USACE, assuming that they have credits available. If not, SNC will submit a SOCA form from AA Shaw Mitigation Bank. SNC will purchase the additional wetland mitigation credits once authorized by USACE.

- 5. Conclusion SNC respectfully requests that USACE authorize this permit modification, which includes updating 1.40 acres of temporary wetland impacts to permanent impacts, and purchasing 2.10 additional wetland mitigation credits as compensation. The existing USACE Permit SAS-2007-01837 expires on September 30, 2020. SNC would like to complete this modification prior to permit expiration.
