ACCEPTANCE FOR REVIEW OF OKLO, INC., TOPICAL REPORT, QUALITY ASSURANCE PROGRAM DESCRIPTION DESIGN AND CONSTRUCTION, REVISION 0 (CAC NO. 000431)

Dear Ms. Cochran:

By letter dated June 30, 2019 (Agencywide Documents Access and Management System Accession No. ML19178A068), Oklo, Inc. (Oklo), submitted the topical report, Quality Assurance Program Description Design and Construction, Revision 0 (ADAMS Accession No. ML19178A069), for U.S. Nuclear Regulatory Commission (NRC) staff review. The NRC staff has performed an acceptance review of the quality assurance program description (QAPD) topical report and found that the material presented provides the technical information in sufficient detail to enable the staff to complete a detailed technical review. The NRC staff estimates that the review will require approximately 200 staff hours, including project management time.

Based on the acceptance review, the NRC staff expects to issue its draft safety evaluation by March 2020. This date could change due to several factors, including the need for and timeliness of responses to requests for additional information; unanticipated changes to the scope of the review; and unsolicited supplements to the topical report. In addition, the Advisory Committee on Reactor Safeguards (ACRS) will be notified of the QAPD review and may choose to discuss the report at an ACRS meeting, which may impact the schedule for issuing the final safety evaluation to Oklo.

The NRC staff and Oklo discussed and agreed upon the review schedule milestones and estimated review costs in a telephone conference on July 31, 2019, among Caroline Cochran, Co-Founder and Chief Operating Officer, Oklo; Alexandra Popova-Renner, Director of Licensing, Oklo; and Jan Mazza, Project Manager, Advanced Reactor Licensing Branch, NRC.

Title 10 of the Code of Federal Regulations 170.21, Schedule of Fees for Production and Utilization Facilities, Review of Standard Referenced Design Approvals, Special Projects, Inspections, and Import and Export Licenses, states that topical reports are subject to fees based on the full cost of the review. Oklo did not request a fee waiver; therefore, NRC staff hours will be billed accordingly.
