WITHHOLDING PROPRIETARY INFORMATION FROM PUBLIC DISCLOSURE - OKLO INC., DRAFT PRINCIPAL DESIGN CRITERIA REPORT AND DG-1353 PILOT REPORT

Dear Ms. Cochran:

This letter is in response to two matters regarding Oklo, Inc. (Oklo) requests for withholding information from public disclosure pursuant to 10 CFR 2.390.

In regards to the Oklo, Draft Principal Design Criteria Report, submitted July 30, 2018, (NRC Agencywide Documents Access and Management System (ADAMS) Accession No. ML18211A258 Letter, ML18207A679 Affidavit), Oklo verbally requested on October 11, 2018 to withdraw this document. The NRC has considered this request and determined that Oklo can withdraw the document. In order to do this, Oklo should submit a request in writing citing 10 CFR 2.390 (c)(3), and indicating that items (i) thru(v) do not apply to the document. However, the Oklo PDC Report Comments matrix that NRC staff provided to Oklo during the closed meeting on September 20, 2018, will be retained by the NRC as it is subject to the Federal Records Act and to any future Freedom of Information Act (FOIA) requests. The NRC will continue to withhold the staff Oklo PDC Report Comments matrix from public disclosure to allow Oklo the opportunity to identify proprietary or export controlled information. The results of this review along with the request for withdraw of the Draft Principal Design Criteria Report, should be submitted to the NRC within 10 business days of this letter. After 10 business days, the Oklo Draft Principal Design Criteria Report, and the NRC staff Oklo PDC Report Comments matrix will be made available for public viewing through the Publicly Available Records component of NRCs ADAMS. The NRC is providing the staffs Oklo PDC Report Comments matrix as an enclosure to this letter.

In regards to the Oklo, DG-1353 Pilot, report submitted September 30, 2018, (NRC ADAMS Accession No. ML18282A003 Letter, ML18282A004 Affidavit), Oklo provided both a non-public bracketed and portion marked version as well as a public version of this document. The public version of the document did not show blacked out redactions, rather it truncated the redacted portions showing no blacked out space. The NRC cannot require Oklo to submit a redacted version of a document, however in the absence of a redacted version the NRC will prepare the document for public release in its own preferred format. The NRC is providing its redacted version of the DG-1353 Pilot report as an enclosure to this letter.

C. Cochran 2 We will delay placing the enclosed redacted version of the Oklo, DG-1353 Pilot report in the public document room for a period of 10 business days from the date of this letter to provide you with the opportunity to identify any proprietary or export controlled information. After 10 business days, the enclosed NRC redacted version of the Oklo, DG-1353 Pilot report will be made available for public viewing through the Publicly Available Records component of NRCs ADAMS.
