OKLO, INC. - REVIEW OF SAFEGUARDS INFORMATION PROTECTION AND HANDLING PLAN (EPID NO. L-2017-LRM-0046)
Dear Ms. Cochran:
By letter dated February 28, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19052A225), Oklo, Inc. (Oklo), submitted its Safeguards Information (SGI) Handling and Protection Plan to the U.S. Nuclear Regulatory Commission (NRC) for review for Oklo to gain access to SGI.
By e-mail dated May 31, 2019 (ADAMS Accession No. ML19154A479), the NRC staff requested additional information to complete its review. This information was necessary to demonstrate Oklos compliance with the regulations in Title 10 of the Code of Federal Regulations (10 CFR)
Part 73, Physical Protection of Plants and Materials, and 10 CFR Part 50, Domestic Licensing of Production and Utilization Facilities. By letter dated June 30, 2019 (ADAMS Accession No. ML19182A339), Oklo responded to this request, including Revision 1 to its SGI Handling and Protection Plan.
By e-mail dated August 12, 2019 (ADAMS Accession No. ML19261A171), the NRC staff sent a draft request for additional information to Oklo regarding Revision 1 of the SGI Handling and Protection Plan. During a teleconference on August 13, 2019, the NRC staff and Oklo discussed the draft request for additional information and other clarifications on Revision 1 of the SGI Handling and Protection Plan, and the internal implementing procedures referenced in it. By letter dated September 12, 2019 (ADAMS Accession No. ML19256A002), Oklo submitted Revision 2 of the SGI Handling and Protection Plan.
Based upon its review of Oklos SGI Handling and Protection Plan, as revised, the NRC staff has determined that Oklo has provided sufficient assurance that it will protect SGI that it produces, receives, or acquires from unauthorized disclosure in accordance with the requirements of 10 CFR 73.21, Protection of Safeguards Information: Performance Requirements, and 10 CFR 73.22, Protection of Safeguards Information: Specific Requirements.
Further, the NRC is hereby informing Oklo that it is subject to the requirements of the enclosed Order EA-06-203, Order Imposing Fingerprinting and Criminal History Records Check Requirements for Access to Safeguards Information. Attachment 1 to EA-06-203 contains a list of licensees that were the subject of the original order in 2006 and, as such, is not included in the enclosure.
C. Cochran 2 By letter dated August 16, 2019 (ADAMS Accession No. ML19254B794), Oklo submitted fingerprints and nominated reviewing officials to grant access to SGI. By letter dated September 12, 2019 (ADAMS Accession No. ML19253D658), the NRC staff approved the Oklo reviewing officials. While the NRC staff acknowledges that by nominating and receiving approval for reviewing officials, Oklo has complied with Section III, C 1 - 2 of Order EA-06-203, the NRC staff is requesting that Oklo acknowledge that it will continue to comply with the requirements of Order EA-06-203 upon receipt of this letter.
