RESPONSE TO OKLO INC. LETTER ON THE NRCS REVIEW OF THE PREVIOUSLY SUBMITTED QUALITY ASSURANCE PROGRAM DESCRIPTION TOPICAL REPORT
Dear Ms. Cochran:
By letter dated June 19, 2019, Oklo Inc. (Oklo) submitted a letter to the U.S. Nuclear Regulatory Commission (NRC), available through NRC Agencywide Documents Access and Management System (ADAMS) Accession No. ML19170A419, requesting that the NRC abandon the paused review work on Oklos previously submitted quality assurance program description (QAPD) topical report.
By letter dated April 21, 2017, Oklo submitted its QAPD topical report (ADAMS Accession No. ML17114A468). The NRC staff accepted the report for review on May 24, 2017 (ADAMS Accession No. ML17143A321) and issued a request for additional information (RAI) on October 23, 2017 (ADAMS Accession No. ML17276B791). Oklo submitted RAI responses and updated the QAPD topical report on November 27, 2017 (ADAMS Accession Nos. ML18011A150 (letter), ML18011A151 (RAI response), and ML18011A153 (QAPD topical report, Revision 1)). The updated QAPD topical report revised the scope of the QAPD to support a custom combined license application rather than a design certification. The NRC staff and Oklo discussed the additional updates needed to Revision 1 of the QAPD topical report to address this change in scope during conference calls on December 19, 2017, and January 11, 2018. At that time, Oklo agreed to update Revision 1 of the QAPD topical report.
As noted above, in a letter dated June 19, 2019, Oklo asked the NRC to abandon its review of the revised QAPD topical report. In response to that letter, the NRC staff agrees to close the review of the Oklo QAPD topical report, Revision 1, submitted on April 21, 2017.
On June 30, 2019 Oklo submitted a new QAPD topical report, Quality Assurance Program Description Design and Construction - Revision 0, for NRC review (ML19178A068 letter, ML19170A419 QAPD plan). The NRC staff will commence a new review in accordance with the process described in NRC Office of Nuclear Reactor Regulation Office Instruction LIC-500, Topical Report Process, Revision 7, dated October 18, 2018 (ADAMS Accession No. ML18227A063).
