COALlTION FOR SAFE ELECTRIC POWER ISSONS FOR IATE FILING OF PEr1 TION F0tt LFAVE TO INTERVBIE IN OPERATING LlCHEE HFARING In accordance with Atomic Safety and Licensing Boaztl Memorandum and Order of July 10, 1973, the Coalition for Safe Eectric Power hereby advises that the Coaliti'en was late in filing Petition for Leave to Intervene in the Opesating License Hearing for the following reasons:

(1) Although the Coalition for Safe Rectric Power was accretod as intervonor in the Davis-Eesse Construction Licensing Hearing and had filed petition for intervention in the Environmental Hearing, the Atomic Ehergy Cocunission did not notify the Ccalition of the forthcoming operation hearing by sending the Coalition a notico.

(2) The Coalition first learned about the forthcoming operation hearing from a newspaper reporter on May h,1973, which did not givo the Coalition 30-days riotice of the forthconung hearing.

(3) Although the Coalition had received a copy of the Final Safety Analysis Report for the: Davis-Besse Plant earlier, the Coalition was deeply involved in preparations for the forthcoming invironmental Hearing and did not anticipate that the notice for an operating license would be issued cefore the Envircraental Hearing was held.

(h) On May h, the Hearing Board for the Environmental Hearings issued a Notice anel Order for Spoeial Pro-Huaring Conference of May 22, and tho Coalition was to present information to the board regarding the Coalition's interests and the contentions and basis therefor.

2 (5) As a consequence of the necessity of preparations for the Environmental I!carings and the Special Pre-Hearing Ccnference, the work load made it impossible for the Coalitii.n to submit a Petition for Leave to Intervene in tho Operating Liconce llearing on time.

(6) Therefore, a telegram was sent to the Atomic Energy Commission on May 30, I

notifying the Commiscion of the Coalitions intent to file an intervention petition in the Operating License Hearing, and requesting that telegram be treated as timely notico. Potition for Intervention was filed as soon thereafter as possible.
