(1) Do the Perry and Davis-Desse Nuclear Power Plants afford CEI and TE a competitive advantage when their actual costs are auch that they do not provide a lower average cost of bulk power supply t han would non-nuclear generation options CEI and TE could have exercised in the same time frame (see 10 C.F.R. Part 50, App. L. SS 11.11, 11.12)?

(2) If the Perry and Davis-Desse Nuclear Power Plants do not afford CEI and TE a competitive advantage, can their ownership share of those plants " create" or maintain a situation inconsistent with the antf(rust laws" (Section 105(c)(5) of the Atomic Energy Act, as amended) such that the NRC is authorized to impose or retain license conditions?

(3) If the Perry and Davis-Besse Nuclear Power Plants do not afford CEI and TE a lower average cost of bulk power supply than would non-nuclear generation options they could have exercised in the same time frame, does imposition or retention of license conditions under Section 105c of the Atomic Energy Act, as amended, deny CEI and TE equal protection and due procesa under the Fifth Amendment of the U.S. Constitution?
