APPLICANT'S MOTICN FOR LICENSI AUTHORIIING OPEEATIONS UP TO AND INCLUDING 35% RATED PCWER OPERATICNS At the close of the evidentiary hearings in this proceed-ing Applicant orally moved for authorization to ascend to a 35% power level. (Tr. 5240). The Staff requested that such motion be in writ =g (Tr. 5242-3); the Board concur;ed (Tr. 5256). Applicant's vritten request folicws.

On January 23, 1981, the Commission granted Applicant a license to ecmmence fuel loading, initial criticality and zero power physics testing activities. Applicant's present schedule calls for this work to be completed by May 15, 1981. There-after, additional licensing authority will be necessary. The timely grant of 35% power operations will provide Applicant with approximately 4-6 weeks additional testing and inspection work; a full power license will be necessary in mid to late June 1981.

authorized. 1/ Such section requires that this Board "shall make findings on the matters specified in paragraph (a) cf this section as to which there is a =cntroversy...." The essence of Applicant's posi:10n is that while controversy may pertain to full pcwer operaticns, the record Zails to provide any evi-dance that challenges Applicant's entitlement to a license authorizing operatiens up to and including 25% rated pcwer.

The issue in this proceeding is whether hydrogen will be

generated in t=otnes in excess of 10 CFR 550.44, and, if so, whether such will ignite so as to cause a breach of centain=ent and emission of radicactivity to the general environmen resulting in pcpulation deses in excess of 10 CFR Part 10C limits. The focus of the hearing has centered on the Three-Mile Island ("TMI") acciden and similar tv.o.e events. _2/

See Applicant and Staff discussion of this matter at Tr. 2815-6, 2831-2 and 3119-24. The record reflects that Intervenor has failed in this burden. Indeed, the three aspects of Inter-venor's case, viz., censideration of psychological criteria, l an alleged faulty weld and the adequacy of the mitigation i system, raise matters other than the credibility of an acci-i

. dent. These matters will properly be addressed in the Initial Decision of this Board. Intervenor's failure to present evidence concerning other accident scenarios, pro-l l

perly fccuses attention on a TMI-type accident.

March 24, 1981 5,/ At the last session of the evidentiary hearings, Applicant requested that this Board issue a decision within 35 days frcm receipt of proposed findings of fact and conclusions of law. See 10 CFR Part 2, Appendix A, VI(d). Given that

proposed findings will be filed by Applicant and all other l parties on April 8 and 13 respectively, the date for Board action would be May 18, 1981. Applicant is cognizant that the timing cf the issuance of the Initial Decision is a matter within the Board's discretion. As noted above, even given the issuance of a 357, license, it is anticipated that a full power license is necessary in the June 15-July 1 time frame. Again, given the fact that the immediate effectiveness rule has been suspended, Board action well before this date is necessary, so as to provide sufficient time for Commission review.
