In its Order dated January 29, 1961, this Atomic Safety and Licensing Board set February 24, 1961, as the opening date for the subject reopened hearing. A schedule had been arrived at in a pnone conference on January 2o, 19o1. This senedule also closed discovery requests as of January 2d, called for Applicant's filing of testimony oy February 9; CESG's, February 12; and Staff's February 17, a date which Staff indica:ed it was trying to meet. No date was set for filing responses to outstanding discovery requests. The Board in another Order, January 27, 1901, required that the parties submit in "prefilec written testimony" responses to four questions concerning new values for the pressure capability of tne McGuire containments.

CESG here moves the Board to provide it relief by reconsidering the schedule and the Order to prefile a written response to the Board's four questions. Good cause exists for such reconsideration.

Contentions 2, 3, and h, which the Board admitted in its Order te reopen, Sov. 23, 1960, place certain burdens of proof cn LRC Staff. Onese burcens will presumably be addressed in NRC testimony which will be servec, at the earliest, February 17 CESG has no way of knowing what Staff's response will be in attempting to meet this burden. requirements for reopening, the major one of which is that consideration be given to matters which, if initially before the

Soard could have changed the Initial Decision, CESG should be given an adequate opportunity to evaluate the Staff's position before going to hearing. The relevant language of the contentions:

"Neither licensee nor SRC staff has demonstrated . . ."

" Licensee and NRC planning do not provide . . ."

In regard to answering the four questions in the Board's Order of January 27, CESG does not have access to the.volumincus engineering information on which the response to question 1) would be based. Nor does CESG have the resources or time to utilize such information. Not having available Staff's response to this question it cannot respond to the remaining questions.

Consequently CESG requests this relief from the Board:

1. That CESG submit its prefiled testimony 7 days after it receives the complete prefiled testimony of

2. That, in compliance with 10 CFR 52.7h3 (b), the hearing be commenced no sooner than 15 days after the completion of filing testimony.'

ESG Applicant has expressed concerns about delay which it attributed to CESG in the recent phone conferences. Applicant initially expressed the goal of putting McGuire-1 on line in the winter of 1975-6. It has been Applicant's adjustment to actual demand trends, as opposed to its over-ferecasts, not any action attributable to CESG, that slowed the construction of McGuire. Not until its cc.pacity is required will it be legally permissible to enter into the rate base as "used and useful". Currently much remains to be done to meet NRC Staff requirements, see " Briefing For Commissioer Gilinsky on McGuire Operating License", January 21, 1991, p. 12, 17,
