Discussion of Issues A. BACKGROUND During the fall of 1979, the Gaston County Board of Commissioners learned of the formal plans of Duke Power Company to move spent nuclear fuel from the Oconee Nuclear Station at Seneca, South Carolina to the McGuire Nuclear Station located on Lake Norman, north of Charlotte. The movement of the three hundred (300) plus shipments would be routed through Gaston County under the Duke Power Company's route proposals.
The primary route of Interstate 85/Inter state 77 has at last word been denied by the Nuclear Regulatory Commission due to regulation of routing around population centers, having a set number of people. Due to the primary route denied, Duke Power Company has currently proposed two alternate routes through Gaston County. Both of the secondary routes under consideration are highly congested; have sections of narrow roadway; and run directly through the center of a municipal ity, with all the related municipal traffic problems.
B. ALTERNATE ROUTES FOR NUCLEAR FUEL SHIPMENT One alternate route would carry the casks of spent nuclear fuel along SC/NC 18 to NC 180 and
Page 2 and intersecting NC 150 northeast of Shelby.
NC 150 then proceeds northeastwardly through the center of Cherryville into Lincoln County and finally to the McGuire facility. This route would take the shipments through thirty-six (36) municipal intersections and seven (7) rural intersections along two-laned narrow roads with many pronounced curves. The portion of this proposed route through Gaston County is shown on the map labeled Appendix along with accom panying photograph taken along the proposed route.
The other alternate route proposed by the Duke Power Company would follow Interstate 85 through the center of the County to NC 273, then northerly through a densely populated residential area, the downtown section of Mount Holly, and intersect NC 16 west of the Mountain Island Dam on the Catawba River, finally turning northward on NC 16 through Lucia and out of the County.
The proposed routing along Interstate 85 and NC 273 passes through the municipalities of Gastonia, Lowell, McAdenville, Mount Holly and skirts the municipalities of Ranlo, Cramerton and Belmont. Effect population that would be in close proximity to this proposed route would be in excess of 100,000.
Page 3 This proposed route provides a four-laned roadways until it reaches approximately .4 mile south of the Mount Holly city limits where NC 273 is reduced to a two-laned road. NC 273 bisects the center of Mount Holly and crosses two (2) railroad grade crossings and NC 27 which is a heavily traveled route at the center of town.
The Seaboard Coastline grade crossing located at the intersection of NC 273 and NC 27, at the center of town, has been the site of many vehicle-train accidents. Also, long delays have been experienced by motorists waiting for trains to clear the crossing.
NC 273 continues northward on a narrow road laden with many pronounced curves. This road passes the new Freightliner plant that is projected to employ approximately 1,500 persons in the coming year. This roadway then intersects NC 16 which is also a heavily traveled route between the Hickory-Lincolnton area and Charlotte.
The portion of this proposed route through the County is shown on map labeled Appendix along with accompanying photographs taken along the proposed route.

LACK OF INFORMATION PRESENTED TO THE BOARD OF COMMISSIONERS The Board of Commissioners have at numerous times posed pecific questions to Duke Power and other Officials and have not ascertained concrete answers to these questions. Several important questions must be answered to the satisfaction of the Board before a logical analysis of the trans portation of the nuclear fuel can be completed.
These auestions are:
- 1. In the event of an accident, what immedi ate area would be affected should a cask be ruptrued during such a vehicular
. accident; i.e., the amount of radiactive gases released; area effected by the con taminated water from the cask. We would also want to know time periods involved for the affected area to be safe for its use before said potential accident.
- 2. What would be the long term physical effects to persons exposed to radiation leaks from the cask, should such occur?
- 3. What are the specific training methods and level of readiness of the first respondants (Highway Patrol) to a nuclear accident involving one of the casks?

- 4. What level of training should be received by County Emergency Services, County Police and Fire personnel in reacting to a nuclear emergency involving one or more of the casks, and who would provide and finance necessary training?
- 5. What would be the reaction time (both by air and ground) for the second respondant teams who are charged with determining the environmental damage and safety of the area?
- 6. In the event of an accident, who would provide necessary warning equipment, such as lights warning devices, necessary equipment used in a mop-up operation?
- 7. Would Duke Power Company assume all legal responsibility and financial obligations in conjunction with any accident involving personal injury or property damage?
- 8. What type education and awareness programs would Duke Power Company be required to provide the citizens of the County before shipments would begin?
- 9. Why have the additional safety measures of warning cars in both front and back of the shipment not been planned into the proposal?

- 10. Why has the Nuclear Regulatory Commission rejected the primary, safest and most logical route of Interstate 85-Interstate 77?
The Board is aware of the rule which pre cludes nuclear shipments from population centers of over 100,000, but still does not understand why the NRC would deny the safest proposed route and opt for one of the pro posed alternate routes .where the shipments would be in greater danger of vehicular accidents or sabotage by traveling two-laned roads with many stops, and dangerous inter sections, and municipal congestion.
Thus, the lack of specific information from both Duke Power Company and the Federal Government leads the Board of Commissioners to the following position.
D. POSITION OF THE BOARD OF COMMISSIONERS AS RELATED TO MOVEMENT OF SPENT NUCLEAR FUEL THROUGH GASTON COUNTY After careful review of the proposal by Duke Power Company to transport casks of spent nuclear fuel through Gaston County, the Board of County Commissioners unanimously agree on the following position:
Page 7 Point 1. In the consideration of the health, safety and general welfare of the general populace of Gaston County, the Board of County Commissioners wish to go on record in opposition of the proposal of Duke Power Company to trans port spent nuclear fuel through Gaston County.
The Board believes the spent nuclear fuels produced by the Oconee Nuclear facility should remain and be stored at that facility until the Federal government makes a final decision upon the final solution to the problem of spent fuel from nuclear reactors.
Point 2. Under no circumstance should the Atomic Safety and Licensing Board allow the shipments of spent nuclear fuel to be moved by either alternate route proposed by Duke Power Company, as discussed earlier in the background.
Point 3. Should the Nuclear Regulatory Commission approve the movement of spent fuel assemblies from Oconee to McGuire, then the Atomic Safety and Licensing Board should only approve the primary route of Interstate 85 Interstate 77 which would provide a major
Page 8 four-laned highway with controlled access.
This route would not run through the center of any municipal, and would exclude all stop and go traffic, railroad grades and general municipal related traffic problems.
Point 4. Should the Atomic Safety and Licensing Board allow the movement of the spent nuclear fuel from the Oconee facility to the McGuire faciliL, then the Board feels that certain conditons safety measures and additional training for County personnel should be required.
These measures should include:
- a. Warning vehicles in front and behind of the shipments.
- b. Training for County Emergency Services, County Police and Fire personnel in the handling (all aspects) of potential nuclear accidents.
- c. County personnel should be advised of the schedule of all shipments a minimum of 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> in advance.
- d. Duke Power Company should not be allowed to transport any nuclear fuel casks except under ideal weather conditions; i.e., shipment only be moved on days
Page 9 absent of rain, snow or windy days which would be conducive to vehicular accidents.
- e. The proposed shipments of fuel casks should only be moved during daylight hours.
- f. Duke Power Companyshould be required to advise residents along the route of the specific roads selected for the transport of nuclear waste, and also advise that the area could be subject to an accident that may involve radio active releases. This should be done at least annually and could be sent accompanying utility bills. For effected areas under the Rutherford Electrical Membership Corporation, Duke Power should either mail direct to residents or place the same notices in the REMC utility bills.
- g. There should be more precautions taken in certain areas along the Interstate route; i.e., warning signs on all ramps advising that it is a route for the transport of nuclear waste and advise of the potential dangers. Warning signs
Page 10 should be placed on all routes pass ing either over or under the Interstate route, advising of the aforementioned matter.
- h. Duke Power should coordinate evacuation plans with local governments along the proposed Interstate route. Special emphasis should be given to high density area evacuation plans in the areas where the following roads intersect the Interstate:
- 1. SR 1307 - Edgewood Road
- 2. NC 274 - Bessemer City Road
. US '321
- 4. SR 2264 - New Hope Road (East Ridge Mall area)
- 5. SR 2220 - Cox Road (Gaston Mall area)
- 6. NC 7 - McAdenville Road
- 7. Area around Pharr Yarns in McAdenville
- 8. SR 2093 - Belmont-Mount Holly Road (Belmont Abbey College area)
- 9. NC 273 - Beatty Drive (Abbey Plaza area)
Along with the evacuation plans, coordinated with the local governments, Duke Power should advise all industrial
Page 11 plants management, shopping area management and other groups of the evacuation plans, plus coordinating said plans with these groups in the event of an accident.
- i. Signs should be placed, on 1/2 mile intervals, along the route designating it as a route on which nuclear waste is being transported and alerting motorists to potential hazards. This should be a federal requirement.
Point 5. In the light of recent nuclear accidents, the Board feels that an educa tional program for the County citizens should be provided by Duke Power Company to educate the public to the safety, and/
or potential hazards involved in the move ment of this spent nuclear fueld, should the movement of spent nuclear fuel be allowed by the Atomic Safety and Licensing Board. The program should have the widest County coverage and be conducted several months prior to the beginning of any shipments.
It would be advisable if Duke Power
Page 12 Company would provide an information hotline (toll free) to answer questions relating to possible shipments from the County citizens.
E. CONCLUSION In conclusion, the Board of Ccmmissioners wishes to again state the opposition to the move ment of spent nuclear fuel by Duke Power Company or its agent through Gaston County. Should the movement of spent nuclear fuel become a reality, the Board would hope that the Atomic Safety and Licensing Board would reconsider .and grant Duke Power the license to transcort these materials over their primary route of Interstate 85/Inter state 77 which is the safest and most logical route.
Under no circumstance should the alternate routes currently being proposed be permitted to be used for the shipments. Also, the Board feels that all of the aforementioned measures in Points 4 and 5 should be required should the shipments be allowed.
Finally, the Board, as others, realize that the movement and storage of these spent nuclear fuel assemblies is not the final answer. The Board would encourage the Nuclear Regulatory Commission and Federal Government to extend the
Page 13 necessary energies and monies to make the final recycling, or disposal of these spent fuel assemblies a reality.

In the late summer of 1979, the Gaston County Board of Commissioners was advised of plans by the Duke Power Company to transport spent nuclear fuel from the Oconee Nuclear Station in South Carolina to the McQuire Nuclear Station on Lake Norman. The primary route for the shipments as proposed, (according to Duke Power Company), is 1-85 through Gaston County to 1-77 in Mecklenburg County, then to McGuire. The Nuclear Regulatory Commission has denied this route because of the shipments passing near a city of over 100,000 population, which is Charlette.
Current alternate routes prsposed by the Utility cause shipments to pass through the downtzwn portions of two municipalities; ie, Cherryville on:'NC 150 and Mount Holly on NC 273. The roads on these alternate routes are narrow and congested and have related municipal downtown traffic probles with which to contend. The route through Mount Holly also passes over a dangerous railroad coossing which has, in the past, been the scene of a number of vehicle-train accidents.
Ln consideration of the general health and safety of the pLpulace of Gaston County, the Board of Commissioners has gone on record opposing the transport routes of the spent nuclear fuel. Enclosed for your reference is a certified copy of the resolution adopted by the Board. The Board would be receptive to any suggestions from you or the state staff in the opposition to the proposed shipping routes for spent nuclear fuel through the county.
