Since there was some question of complete unanimity of agreement on adoption of the proposed position paper in this matter and in order to obtain unanimous approval of it as written, Resolution Number 129, dated April 24, 1980, concerning the adoption of the position document on trans portation of spent nuclear fuel included authorization for individual Commissioners to make separate statements to be included with the position document to be submitted to the Atomic Safety and Licensing Board on April 28, 1980.

Because this paper and the forwarding letter were prepared prior to the policy change which the Nuclear Regulatory Commission announced on April 23,.1980, that apparently will permit in proper instances and under proper safeguards transportation of nuclear wastes on routes. which were previously denied, I feel that additional comment on my part is required to explain my objection to the paper.

I agree in substance with the position document. I believe that the change in regulations which will possibly permit the approval of interstate routes through Gaston County for this transportation of these nuclear wastes.

should mitigate our opposition to any transport through the County and lead us to support Duke Power Company in its application for transportation along interstate routes, provided that this route is sought and approved as a continuous route through both Gaston and Mecklenburg Counties, while continuing to oppose by means available to us the use of the alternate routes or either of them through Gaston County. This because I believe a minimum of such transportation is necessary, that Duke Power Company's application will be authorized over some route running through Gaston County, and that interstate routes are safer, can be better protected and constitute less over-all danger than do routes over lesser road&.

Because the members of the Board want to assure ourselves and the residents of the County that every effort has been made to protect them in the movement of any such wastes, both by us as their representatives and by Duke Power as the applicant for approval to transport, I agree with the position document in all respects except as to those portions, particularly the first sentence of the conclusion (page 12) and the sentence in the second paragraph of the forwarding letter signed by Chairman Rhyne and dated April 15, 1980, which 841 PAGE 2 Atomic Safety and Licensing Board April 25, 1980 proport to unanimously oppose the shipment of spent nuclear fuel through Gaston County. I am not in opposition to transporting through Gaston County in any manner, and would support Duke Power Company in its efforts to move necessary waste materials along the interstate routes in both counties if adequate safeguards are required and provided.

Since the fall of 1979, the Board of Commissioners has been following with great interest the proceeding concerning the potential movement of spent nuclear fuel assemblies by Duke Power Company from the Oconee Nuclear Station to the McGuire Nuclear Station. The Board has never totally favored the movement of spent nuclear fuel through Gaston County.

However, the Board does realize that the movement of spent nuclear fuels is one of the evils In the use of nuclear energy to provide our electrical needs.

The major concern of the Board is for the safety and physical and mental welfare of the citizens which we, the Board, serves.

Cue to the factors of sketchina information, or in some cases the void of information in specific areas; and the refusal of the primary route by the Nuclear Reg ulatory Commission which was proposed by Duke Power Company, the Board unanimously opposes the shipment of spent nuclear fuel through Gaston County. Also, we must strongly oppose and protest the use of the two alternate routes currently being proposed by Duke Power Company for the transport of the nuclear wastes.

These positions are outlined in greater detail in the accompanying position paper.

The Board respectfully presents this paper to the Atomic Safety and Licensing Board and requests that the points, as outlined, be given serious consideration in any decision of the Board and Nuclear Regulatory Commission.
