NRC STAFF'S ANSWER TO REQUEST FOR HEARING FILED BY MICHEL A.PHILIPPON CONCERNING DENIAL -
OF SENIOR REACTOR OPERATOR LICENSE APPLICATION The NRC Staff, pursuant to 10 C.F.R. 6 2.1205(g), hereby submits its answer to the request for hearing filed by Michel A. Philippon, dated October 16,1998, in regard to the denial of Mr. Philippon's application for a senior reactor operator license. For the reasons set forth below, the Staff does not object to Mr. Philippon's hearing request.
BACKGROUND In April 1998, Mr. Philippon took an examination for a senior reactor operator license.
The Staffissued a proposed denial of the license, for failure to pass the operating test portion of i
the examination, on May 20,1998. On July 2,1998, Mr. Philippon requested an NRC review of the grading of his examination. Following an informal review by the Staff and an evaluation by an Appeal Panel, Mr. Philippon was informed by the Staff by letter dated October 4,1998, that he did not pass the operating test. The Staff's letter also provided Mr. Philippon with an j opportunity to request a hearing within twenty days. By letter dated October 16, 1998, I i

g- i Mr. Philippon requested a hearing. On October 28,1998, the Presiding Officerin this proceeding was designated.
DISCUSSION Mr. Philippon was provided with an opportunity to request a hearing concerning the .,
denial of his senior reactor operator license until October 24,1998. He filed his request for a hearing within the time allowed. Accordingly, the Staff does not object to Mr. Philippon's hearing request.
CONCLUSION The Staff does not object to the granting of the hearing request filed by Mr. Philippon.
