ORDER Pursuant to the Presiding Officer's November 13, 1998 order, the NRC Staff is required to file the hearing file in this proceeding on or before December 14, 1998.

The order also directed the Staff to file a pleading by November 23, 1998, i

setting forth its best estimate of the length of the hearing i

file.

Further, it also instructed Mr. Philippon to inform the Presiding Officer by December 3, 1998, of his estimate of the time needed to prepare his written presentation challenging the Staff's denial of his license applicatio'n.

On November 23, 1998, the Staff filed a pleading stating the hearing file would be approximately 900 pages.

In a filing also dated. November 23, 1998, Mr. Philippon states that he will need b

1 15 days to prepare his written presentation.

Nothing in Mr.

Philippon's filing, however, indicates that he was aware of the length of the hearing file at the time of his November 23 filing.

In light of these circumstances, Mr. Philippon's written presentation shall be filed by January 8, 1999.

Any regaest for additional time by Mr. Philippon shall be filed so that it is in the hands of the Presiding Officer no later than January 6, 1999.
