NRC STAFF'S MOTION FOR EXTENSION OF TIME The NRC Staff (Staff) hereby moves the Presiding Officer for an extension of time to file answers to the additional questions set forth in the Order dated June 16,1999 (Order). The Order directs the Staff to file its answers on or before June 30,1999, and Mr. Philippon to file any response on or before July 7,1999. The Staff respectfully requests that the foregoing schedule i

be extended to July 9 and July 23, respectively.

The two members of Staff, Mr. Peterson and Mr. Vick, who have been principally  :

1

- responsible for preparing the responses in this case both have outstanding assignments with deadlines that will cause them to be unable to devote any time to the preparation of answers to the Presiding Officer's questions for at least one full week. Mr. Vick is currently on extended  !

business travel and will not return to the office until next week, and Mr. Peterson is in the middle of completing the necessary work on an unrelated examination, among other assignments.

On this date, Mr. Philippon stated, during a telephone conversation with the undersigned,

. that his first preference is to file his reply to the Staff's answers on July 7 because of a vacation 9906280071 990623 .

However, he also said that if the Staffis unable to file its answers by the current June 30 due date, he does not object to the Staff's proposed due date of July 9 provided he is permitted to file his reply by July 23, since he will still be on vacation for several l

days following July 9, and thus will be unable to immediately work on his response. )

l CONCLUSION I In consideration of the foregoing, the Staff requests that this Motion be granted. l Respectfully submitted,
