NRC STAFF'S MOTION FOR EXTENSf0N OF TJME <

The NRC Staff (Staff) hereby raoves the' Presiding Officer for an extension of time to file answers to the questions set forth in the appendix to the Order issued by the Presiding Officer l

dated March 19,1999. Presently, the answers of the Staff and Mr. Philippon are due to be filed I by April 2,1999; responses to each side's answers are due one week later. The Staff respectfully requests that the foregoing schedule be delayed two weeks, to April 16 and 23 respectively. i The Staff personne! qualified to provide the answers to the Presiding Officer's questions

Staff management has recently been able to reassign certain matters, the time remaining before thc =swers are due is insufficient to prepare the Staff's answers. In addition, the handwritten notes of the examiner that are being typed pursuant to the Presiding Officer's Order are extensive.

More time is necessary to comi.lete the transcription process.

' On this date, counsel for the Staff attempted to contact Mr. Philippon to determine his position on this Motion. The undersigned spoke to Mrs. Philippon by telephone [(734) 587-3037], who indicated that Mr. Philippon was home but unavailable. Mrs. Philippon stated that the Staff could represent that Mr. Philippon would not have an objection to the proposed revised schedule. The undersigned agreed with Mrs. Philippon that should Mr. Philippon later object to this Motion, he could contact Staffcounsel or the Presiding Officer directly to update his position.

In consideration of the foregoing, the Staff requests that this Motion be granted.
