MOTION TO SUBPOENA DR. M. READA BASSIOUNI IN LITIGATION OF EDDLEMAN CONTERTION 57-C-3 (Nighttime Sirens)
NOW COMES Lacy H. Thornburg, Attorney General of North Carolina , and respectfully requests this Board or,its Chair pursuan t to 10 C. F.R. 2.718 and 10 C.F.R. 2.720(a) (1) to issue a subpoena for Dr. M. Reada Bassiouni to testify in the litigation of Eddleman Contention 57-C-3 (2) or to request Applicant CP&L to produce Dr. Bassiouni as a witness (3) or to allow Mr. Eddleman to subpoena Dr. Ba ssio un i .
Pursuant to 10 C . F . R. 2.720(a) and 10 C.F.R. 2.218, the Attorney General respectfully shows the Board the relevance of this request by saying:

- 1. At the initial hearing on this contention held in Raleigh, North Carolina on November 4 and 5, 1985, Mr. Eddleman provided information to all parties and to this Board that Dr. M. Reada Bassiouni had information pertaining to this con ten tion . Subse quen t to Mr . Eddleman's repre sen ta tion , the Board contacted Dr. Ba ssio uni in a spea kerphone telephone call on November 5, 1985.
- 2. During the telephone call, which the Attorney General understands is not part o f the o f ficial record in this lit iga tio n , Dr. Bassiouni sta ted , among other things tha t although CP&L has f ully met the Federal requirements addressed in NUREG 0654 and FEMA-4 3 for the alert and notification system, the nighttime notification of Contention 57-C-3 is not addressed in the Federal guidelines. Dr. Bassiouni went on to sta te tha t ,
" Ho wever , the current installed Harris system can be enhanced to provide nighttime notification, which will be in excess of the guideline requirements."
- 3. Dr. Bassiouni disputed the testimony of a FEMA witness' derivation of awakening percentages for the Harris siren system and implied that the FEMA witriess had relied inappropriately on j l
studies of noise annoyance rather than studies of noise alerting. -
Dr. Bassiouni suggested that an alternate study which specifi-cally focused on night-time sit en alerting was a more appropria te l starting point. '

- 4. Dr. Ba ssio uni further stated his apparent opinion that reliance on an informal alerting system was an inferior sa fe ty stendard to use. He suggested that designing a siren system with nighttime alerting as a target was a better alternative to relying on informal alerting.
- 5. The Attorney General of North Carolina believes all parties should want the nighttime alerting sirens to be designed adequately to protect the health and safety of the citizens o f North Carolina who live within 10 miles of the plant, regardless of whether that siren design neets dr ~ exceeds certain standards.
Dr. Bassiouni's informa tion , there fore , is critical to the determination of this point. ,
- 6. Even though the Attorney General believes this information is relevant to all parties , the Attorney General is further aware that Dr. Bassiouni has in ef fect criticized the FEMA standards upon which CP&L relied. In fairness to FEMA and all parties, the Attorney General points out that Dr. Bassiouni should be produced as a witness so that those who may dispute him have the opportunity to cross examine him and rebut his asser-tions openly and on the record.
To this end, the Attorney General requests this Board subpoena or allow Dr. Ba ssio uni to be subpoenaed to provide relevant information to 'the record about the adequacy of nighttime alerting sirens at Shearon Harris Nuclear Plant.
