ORDER The applicant in this matter, Entergy Nuclear Operations, Inc. (Entergy), has filed an "emergency petition for interlocutory review," relevant to the Board's recent Order granting the State of New York certain cross-examination rights in the upcoming evidentiary hearing.
1  Entergy also seeks to stay the Board's Order (or, alternatively, the hearing on the affected contentions) pending the Commission's decision on its petition.
2  As part of its appeal, Entergy seeks expedited briefing. Pursuant to my authority under 10 C.F.R. § 2.346(a), Entergy's request for expedited briefing is granted. The State of New York has filed an answer.
3  Any other answers to Entergy's petition for review and stay application are due by Friday, October 5, 2012. Any reply to an answer shall be due by Tuesday, October 9, 2012.
