Dear Chairman Wolfe:

February 20, 2020 On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter of February 11, 2020, addressed to the Commission regarding the Indian Point Decommissioning Project. Your letter expresses concern about the pending license transfer application of Indian Point from Entergy to Holtec.

Because the NRC has received requests for hearing on the matter, your letter bears on what is now a contested proceeding before the Commission and it would be inappropriate for the Commission to comment on the matter at this time. This is because the Commission must remain impartial during the pendency of the proceeding. The hearing requests and arguments made concerning the timing of a hearing will be considered in accordance with the agency's procedures.

A copy of your letter and this response will be served on the participants in the Indian Point license transfer proceeding.

Dear Members of the Commission:

February 11, 2020 We write to express our serious concerns about the Nuclear Regulatory Commission's anticipated approval of Holtec International, the private company selected to dismantle the Indian Point nuclear plant.

Indian Point has had a long list of safety concerns over the years, which have posed life-threatening risks to those in the surrounding area. Recently, Attorney General Leticia James released a statement detailing the list of "multiple, grave concerns" citing Holtec's lack of experience with "such an enormous, complex and consequential undertaking." She further questioned whether Holtec had the proper financial resources to carry out the project.

Moreover, the Nuclear Option, a multi-part report published by the Journal News and multiple USA Today Network newsrooms, detailed the profits that private companies would make by decommissioning nuclear power plants. The private companies, including Holtec, promise to complete the decommissioning project faster than the companies that now own the plant, however, questions remain as to whether safety will be sacrificed for speed.

The decommissioning project should be a thoroughly thought out process, comprised of public hearings outlining all aspects of the project that would include plans for handling the spent radioactive fuel, site clean-up and future use of the location.

It's imperative that the residents on both sides of the Hudson River, in Westchester and Rockland Counties, are involved in the discussion. Indian Point is in one of the most densely populated metropolitan areas in the country and our constituents deserve full transparency and a commitment to safety first!

We strongly urge the Nuclear Regulatory Commission to reject Entergy's proposed sale to Holtec International. The handling of a project of this magnitude should be awarded to a reputable and experienced company that will safeguard the concerns of our residents and the environment. We thank you for your attention to this matter of critical importance to Rockland County residents.
