ASLBP No. 07-858-03-LR-BD01 (Indian Point Nuclear Generating Units 2 and 3) April 1, 2016 ORDER (Adopting Joint Motion for Track 2 Hearing Schedule Deferral)

On March 29, 2016, Entergy Nuclear Operations Inc. (Entergy) notified the Licensing Board of recent developments potentially relevant to the Track 2 proceeding.1 During the maintenance outage that commenced on March 7, 2016, Entergy conducted visual and ultrasonic testing of the baffle-former assembly bolts in Indian Point Unit 2.2 It was revealed that approximately one quarter of the baffle-former bolts show signs of degradation.3 Due to Entergys findings, Entergy notified the Board of its intent to initiate consultations with the parties and its proposal that a joint motion be filed requesting an abeyance of the Track 2 proceedings for thirty days.4 1 Letter from Counsel for Entergy Nuclear Operations, Inc., to Lawrence G. On March 30, 2016, the Joint Motion was filed with the Board.5 The Joint Motion requests that pending the availability of further information regarding Entergys baffle-former bolt examination and proposed corrective actions, the Licensing Board defer for thirty-five days: (1) the filing of further evidentiary submissions, i.e. New Yorks supplemental reply testimony concerning the relevance, materiality, and reliability of six proposed exhibits,6 previously due April 1, 20167; and (2) the scheduling of post-hearing findings.8 Additionally, the Joint Motion proposes that a status update be filed by the parties no later than May 6, 2016.9 The Board hereby grants the parties Joint Motion, the requested deferral is granted. The scheduling of the post-hearing filings and the filing of further evidentiary submissions is deferred for a minimum of thirty-five days and will be rescheduled by order of the Board. A status report shall be filed by the parties no later than May 6, 2016.
