ORDER The applicant in this matter, Entergy Nuclear Operations, Inc. (Entergy), has filed an emergency petition for interlocutory review, relevant to the Boards recent Order granting the State of New York certain cross-examination rights in the upcoming evidentiary hearing.1 Entergy also seeks to stay the Boards Order (or, alternatively, the hearing on the affected contentions) pending the Commissions decision on its petition.2 As part of its appeal, Entergy seeks expedited briefing. Pursuant to my authority under 10 C.F.R. § 2.346(a), Entergys request for expedited briefing is granted. The State of New York has filed an answer.3 Any other answers to Entergys petition for review and stay application are due by Friday, October 5, 2012. Any reply to an answer shall be due by Tuesday, October 9, 2012.
