On February 8, 2017, the State of New York and Riverkeeper, Inc. (collectively, Intervenors) filed an unopposed motion requesting the dismissal of the three Track 2 contentions and the termination of this proceeding.1 This motion is based on an amended License Renewal Application filed by Entergy Nuclear Operations, Inc. (Entergy), that was submitted pursuant to a settlement agreement between Intervenors and Entergy under which Indian Point Units 2 and 3 will shut down no later than April 2024 and April 2025, respectively.2 Recognizing that those admitted as interested governmental entities to this proceeding (the Town of Cortlandt, Westchester County, the State of Connecticut, the NYC Department of Environmental Protection, and the Village of Buchanan) have invested time and resources in 1 Intervenors Notice of Withdrawal of Track 2 Contentions and Unopposed Motion to Dismiss Those Contentions and This Proceeding in Its Entirety (Feb. 8, 2017).

this proceeding, the Board provides this opportunity for these entities to submit comments relating to the pending motion to withdraw the Track 2 contentions and terminate this proceeding. Such comments, if any, should be filed through the Electronic Information Exchange no later than February 28, 2017.
