UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 Honorable Lawrence SpottedBird, Chairman Kiowa Indian Tribe P.O. Box 369 Carnegie, OK 73015

SUBJECT:

NOTICE OF AVAILABILITY OF THE FINAL SUPPLEMENTAL ENVIRONMENTAL IMPACT STATEMENT FOR THE COMANCHE PEAK NUCLEAR POWER PLANT, UNITS 1 AND 2, LICENSE RENEWAL (DOCKET NUMBERS: 50-445 AND 50-446)

Dear Chairman Lawrence SpottedBird:

The U.S. Nuclear Regulatory Commission (NRC) staff has completed the environmental impact statement NUREG-1437, Supplemental 60, Generic Environmental Impact Statement for License Renewal of Nuclear Plants Regarding License Renewal of Comanche Peak Nuclear Power Plant Final Report (FSEIS). Comanche Peak Nuclear Power Plant Unit Nos. 1 and 2 (Comanche Peak) is operated by Vistra Operations Company, LLC and is located in Somervell County. In April 2023, the NRC staff initiated consultation under Section 106 of the National Historic Preservation Act of 1966, as amended (NHPA), with your office. In accordance with Title 36 of the Code of Federal Regulations Section 800.8(c), the NRC has elected to use the National Environmental Policy Act of 1969, as amended, process to comply with its obligations under Section 106 of the NHPA.

The FSEIS includes the NRC staffs analysis that evaluates the environmental impacts of the proposed action and alternatives to the proposed action. For Category 1 issues that were previously dispositioned in the NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Revision 1, Final Report (GEIS), no additional site-specific analysis is required in the FSEIS unless new and significant information is identified.

Site-specific issues (Category 2) are those that do not meet one or more of the criteria for Category 1 issues; therefore, an additional site-specific review for the non-generic issues is required, and the results are documented in the FSEIS. Together, the FSEIS and the GEIS evaluate, on a site-specific basis, all the environmental impacts of the proposed continued operation for a period of 20 years for Comanche Peak.

In a letter dated November 13, 2023, the NRC provided the NRCs Agencywide Documents Access and Management System (ADAMS) web address and accession number for the draft SEIS to your office. As discussed in Chapter 4 of the supplement, the NRC staffs recommendation is that the environmental impacts of license renewal for Comanche Peak are reasonable for the license renewal action, preserving the option of license renewal for energy planning. Further, the NRC staff determined that LR would not adversely affect known historic properties or historic and cultural resources.April 29, 2024 L. SpottedBird 2 A copy of the FSEIS is available via the following link:
