CLOSURE OF INVESTIGATION (01 4-2012-005)

Dear Mr. Flores:

This refers to an investigation conducted by the NRC's Office of Investigations regarding activities at the Comanche Peak Nuclear Power Plant. The Office of Investigations initiated the investigation to determine whether employees at Luminant's Comanche Peak Nuclear Power Plant willfully invoked NRC Administrative Letter 98-10 and made changes to Technical Specification

3. 7.17 without prior NRC approval.

Based on the evidence developed during the investigation, the allegation that Comanche Peak Nuclear Power Plant employees willfully invoked NRC Administrative Letter 98-10 and made changes to Technical Specification 3.7.17 without prior NRC approval was not substantiated.

The NRC plans no further action related to the alleged wrongdoing and considers this investigation closed. You should note that final NRC documents may be made available to the public under the Freedom of Information Act subject to redaction of information pursuant to the Freedom of Information Act.
