/'m j .f We are in receipt of a letter dated October 2, 1978 from Thomas A. Baxter to you transmitting a letter from John Carroll of I Northern States Power Co. to this commission. The substance of  !

the enclosed letter is that the in-service dette for Tyrone is l being postponed, due to delay in obtaining a certificate of cublic convenience and necessity from this commission.

It is our understanding from the applicants that the delay is principally caused by three factors; a reassessment of time required to construct the plant, seasonal constraints on con-struction, and an unwillingness on the part of the applicants to make certain pre-certification ec=mitments in the face of this commission's expressed policy to minimize such commitments.

This ccrmission has accepted an application for Tyrone as of September 1, 1978, and, under the Njsconsin Power Plant Siting Law, section 196.491 Wis. Stats., has 540 days : rem that date to make a decision on it.

October 25, 1978 Page 2 by the applicants and never discussed with the commission. In fact, it was first proposed in March 1978 in the application filed at that time. Other submissions assumed a 5-1/2 year construction time, for which a September 1979 licensing date would be more than adecuate. Our review of this project is proceeding on schedule, and, in fact, we will be holding hearing to determine whether the plant is needed sta:: ting December 11, 1978.
