TYRONE ENERGY PARK Gentlemen:

  • With the Commission's acceptance for review of our application for authorization to construct the Tyrone Energy Park, as set out in l your letter of September 12, 1978, we have reviewed in detail our -

schedules for pre-construction and construction activities. This review was undertaken to assess the interplay of your regulatory review schedule and our construction schedules to determine the i in-service schedule for the_Tyrone Energy Park. The results of j this review are set out in Attachments 1, 2 and 3 to this letter. '

As you know, we had expected to obtain a certificate from the Commission in a time frame which would have permitted field con-struction to commence in April 1979. Based on commencement of l construction at that time, fuel loading was planned for December, 1984 and commercial operation was established as April 1985. This j schedule is set out in Attachment No. 1. It is now apparent to all that the Commission's regulatory review cannot be concluded on a schedule to facilitate the start of field construction in April 1979.

Accordingly we have prepared two new schedules reflecting the effects on the plant schedule of (i) realistically attainable regulatory review schedule, and (ii) a regulatory review schedule which utilizes the maximum time allowed by law. These are set out in Attachments 2 and 3, respectively.

The schedule in Attachment 2 is based upon a favorable Commission decision on our application in September 1979. This, of course, is 14 months-after filing of the amended application in June 1978 and 12 months after its acceptance as " complete" by the Commission. l Attachemnt 3 is premised upon a favorable Commission decision in March-1980, i.e., 540 days after acceptance of the application as 1 l

" complete".

l In both instances, the schedules allow seven months between a

, favorable Commission decision and the start of field construction.

In this period, extensive preconstruction activities, including  ;

expansion of the construction management staff and the award of l contracts for early construction efforts would be undertaken. These activities have been' deferred until after a favorable Commission i decision is attained in response to the Commission's admonitions l with respect to the level of pre-certification expenditures. .

If the schedule in Attachment 2 is maintained, an in-service or commercial operation date in April 1986, will be attained for the Tyrone unit. The Attachment 3 schedule would result in a commercial )

operation date in February 1987. The effect of winter weather on i early site construction adds.an incremental four months to the con'-

struction schedule in the Attachment 3 case.

We are confident that the forthcoming hearings now scheduled for December 11, 1978, to examine the need for Tyrone'in light of the additional tests established byythe Commission in paragraph 2 of the Advance Plan Order will confirm the need for Tyrone Energy Park. We also believe that a certificate decision by September 1, . 1979, is realistically attainable in light of the exhaustive consideration of the pertinent matters in the now concluded Advance Plan proceeding.

For these reasons we are establishing the Tyrone unit as a 1986 in-service unit for planning purposes for Northern States Power Company, Dairyland Power Cooperative, Lake Superior District Power Company and Cooperative Power Association.

We respectfully request the Commission to review its planned regula- '
